Research On The Establishment And Registration Management System Of Social Organizations In My Country

Social work service organizations are important types of private non-enterprise units in social organizations and are the main suppliers of professional social work services.In practice,more and more social organizations consciously use the theories and methods of social work to provide social services for the public.With the deepening of the transformation of government functions and the reform of purchasing services from social organizations,social organizations,especially social work service organizations,actively undertake the government purchase of social services.They have made important contributions to solving social problems and promoting social harmony by using professional social work theories and methods.Professional social work has been written into the "government work report" for four consecutive years.Social organization has become an important subject of promoting social governance innovation,and has also become an important channel for the development of social work in China.The establishment registration management system of social organizations in China has gone through the reform stage from the franchise system to the double management,from the double management to the double management and the direct registration.Under the dual management system,on the one hand,the threshold of registration is too high,on the other hand,because of the lack of an public and transparent administrative licensing legal system for business executives,the administrative license of the competent business units is uncertain.A large number of social organizations that are conducive to social development are unable to register in civil affairs departments due to the high threshold of registration or the inability to obtain pre-administrative permission from the competent business units.Although the double management has its historical rationality,under the specific conditions of the increasingly prominent demand for social services,under the background of the lack of open and transparent administrative licensing legal system,excessive registration threshold and double management are losing effectiveness.In the third Plenary Session of the 18th CPC.Central Committee,the direct registration reform of the four types of social organizations was put forward,and implemented a dual-track registration management system combining direct registration with dual management by lowering the threshold and simplifying the procedures.The registration management system for the establishment of foreign social organizations is compulsory registration and voluntary registration.Japan and Singapore implement compulsory registration,The United States and Germany implement voluntary registration,China's compulsory registration management system has absorbed extraterritorial experience.Although the reform of direct registration has the advantages of establishing and cultivating social organizations to facilitate the establishment and development of social organizations,the defects of unclear concepts and unidentified boundaries exist at the moment.In practice,the service ability of the registration and management agencies is also surpassed.The current reform of the direct registration of the four types of social organizations mainly relies on the administrative normative documents of the civil affairs departments,but the Regulations on registration and management of social organizations,the Provisional Regulations for the registration and management of private non-enterprise units and the Regulations on the management of the foundation have not been amended.The legal system for the registration and management of social organizations is still double management.Direct registration is not supported by laws and regulations,which is contrary to the rule of law in an all-round way.The practice of registration and management of social organizations needs to speed up the unified construction of the legal system of social organizations,steadily promote the reform of the registration management system,strengthen the strength of the power of the registration and management agencies and the construction of the rule of law in business management.This will promote the standardization and legalization of social organization management in China so as to promote the overall healthy and orderly development of social organizations in China,including social work service organizations.
