An Empirical Study On The Implementation Of The Power List System By The Harbin Municipal People's Government

On April 27,2018,the State Council held its first clean government working conference.Premier Li Keqiang stressed that governments at all levels should strengthen the restriction and supervision on the operation of power,actively promote the construction of a clean government,speed up the formulation and improvement of power and responsibility lists,further optimize the business environment,and add vitality and convenience to market players and the people.The power list system,as an important reform task deployed by the Party Central Committee and the State Council,is an important measure for the modernization of the national governance system and governance capacity.It is a new scientific governance mode explored in the long-term contest between public power and private rights of the government in China.It has the functions of defining the limits of government power,realizing effective control of power,improving administrative efficiency and building the rule of law.It is of great significance for the government to deepen the reform of the administrative system.In March 2015,the General Office of the Central Committee of the Communist Party of China and the General Office of the State Council jointly issued the Guiding Opinions on Implementing the Power List System of Local Government Work Departments at All Levels,further improving the top-level design of the power list system construction,providing a strong basis for the specific guidance of the construction of the power list system of local governments at all levels throughout the country.Under the background of deepening reform in an all-round way and governing the country according to law,the implementation of the power list system is a revolution in the process of China's administrative system reform.Over the past four years,local governments at all levels throughout the country have been promoting this system in an orderly manner,expecting to achieve the control of administrative power within the scope of the rule of law.As a public official of Harbin municipal directly organs,the author has a deep understanding of the overall situation and specific characteristics of the implementation of the power list system in Harbin through visiting the municipal editorial commission,municipal people's and social Bureau and other departments.The author has also participated in the whole process of the implementation of the power list system in this department(former municipal land and resources bureau).At the time of pushing forward the new round of comprehensive reform of the Party and state institutions,this paper is based on the work practice of Harbin,under the guidance of the theory of administrative law,through empirical research method,to study the implementation of power list system by Harbin Municipal People's Government.Firstly,this paper expounds the basic concept and scope of the power list system,introduces its origin,development and evolution in China,and discusses its jurisprudential attributes and legal significance.Secondly,it makes an empirical analysis of the implementation of the power list system by the Harbin Municipal People's Government,and summarizes the basic principles and importance of the system in the process of implementation.The measures,characteristics and practical results achieved;thirdly,the problems found in the implementation of the power list system by the Harbin Municipal People's Government are analyzed and reflected;finally,some rationalization suggestions are put forward for further implementation of the power list system by the Harbin Municipal People's Government.
