Research On The Legal Issues Of Government Supervision Of The Elderly Service Industry Under The PPP Model

China's aging population is deepening at present,the development of the elderly service industry to provide the elderly with a good living environment and quality care services,to provide spiritual comfort for the elderly is the trend of The Times.Under the background of social and economic structure transformation,the state encourages cooperation,government and social capital using PPP mode to provide public products and services,reduce the pressure on government finances,and the traditional family pension mode has been difficult to meet the increasing demands of the masses of the people,therefore,construction of application of PPP model in the field of pension service pension institutions,improve the quality of life of the elderly,is helpful to promote the harmonious development of society.In the PPP mode in our country to carry out the old-age service practice time is short,the government role in cooperation with social capital difficult to change,for the PPP project supervision is still some deficiencies,on the basis of study of domestic and foreign advanced experience,this paper intends to provide methods to solve these problems from the perspective of administrative law,put forward legal Suggestions to perfect the endowment services regulation the PPP mode.This paper is divided into four parts.The first part introduces the PPP model and relevant theories of the pension service industry,and analyzes the necessity of government supervision of PPP model.In the second part,based on the current situation of the old-age care industry under the PPP mode of government supervision in China,the author finds out the existing legal problems,such as: the legal system of the PPP mode is not perfect,the joint supervision of multiple government departments causes confusion,the regulatory content is not clear,the project effect evaluation is not ideal,the lack of accountability mechanism for government departments and so on.The third part introduces the advanced experience and historical lessons of foreign PPP field toprovide reference for the development of PPP mode in China.The fourth part proposes legal Suggestions to solve the above problems,improve the legal supervision system of PPP mode in China,promote the transformation of the role of the government,and provide the public with high-quality and cheap public goods and services through social capital.
