Research On The Examination And Approval Of Sea Area Use Rights In Dalian Jinpu New Area

The 21st century is the century of the ocean.Countries all over the world are actively seeking development environments other than land resources,so people will gradually focus their development demands on the ocean.With the rapid development of China’s economy,people’s living standards have been continuously improved.Especially in the context of China’s luxury diet culture,marine products are increasingly on people’s dining tables.The market demand of marine products is increasing,which accelerates the expansion of the aquaculture market,such as marine aquaculture and seafood fishing.Since the promulgation and implementation of the Law The People’s Republic of China on the Use of Sea Areas on January 1,2002,coastal provinces of our country have successively promulgated provincial-level and municipal-level sea area use rights management measures.In 2007,the State Oceanic Administration issued Provisions On The Administration Of Maritime Use Rights(hereinafter referred to as the Regulations on Sea Areas).The Property Law also further clarified the nature and status of the right to use the sea area.These further highlight the importance of the right to use the sea area and create legal conditions for the management of the sea area.Due to the issued late of sea area use right,the approval of that has various procedures,long term for approval and other issues characterized by the relative characteristics of materials,facilities and other sea area use rights,its acquisition,operation and disposal processes are relatively complicated,and the scope of application is narrow,and laws and regulations do not perfect.Because of the relatively scarce reality of such laws and regulations,there are many problems in the approval of sea area use rights and long approval time.As the tenth national new district in China,Jinpu New District has many problems to be solved in the examination and approval of sea area use rights.This paper examines the approval work of the sea area use right in the Jinpu New Area by combing the knowledge of the use right approval,and concludes that the approval process is cumbersome and long-term for the approval of the sea area right,the examination and approval work of the power is affected by too many complicated factors,the relevant aquaculture sea support policies and the sea area use cost reduction and exemption policies are insufficient,and the majority of fishermen do not have strong consciousness of using the sea for compensation according to the law and so on in the current Jinpu New Area.By referring to the research results of the examination and approval of sea area use rights domestic and abroad,several suggestions for improving the approval of sea area use rights in Jinpu New Area are put forward,speed up the reform of government institutions and the reform of public institutions,and optimize the functions of the approval authority of sea area use rights,simplify procedure for handing affairs will bring all the convenience business into the window;pay attention to personnel training,strengthen team building,comprehensively improve the scientific and technological level of sea area management,strengthen the dissemination of use sea in law and paid use for sea.This paper analyzes the status quo of the approval of sea area use right in Jinpu New Area,and makes corresponding suggestions.Hope to provide reference for the approval of sea area use right in Jinpu New Area.
