Research On The Regulation Of Online Car-hailing In Rizhao City

With the growing maturity of Internet technology,new formats have emerged in the travel industry.With the rapid development of online car-hailing platform enterprises,the mode of travel of the people has been enriched,and the transfer efficiency has been improved.Online car-hailing has gradually become one of the important choices for residents to travel.However,the rapid expansion of online car-hailing has brought great challenges to government regulation and the development of traditional taxi industry.In 2018,two vicious incidents happened successively,which shocked the whole country.They also sounded a warning to the rapid development of the online car-hailing industry.Safe transportation and promoting compliance are undoubtedly the most important tasks in the field of online car-hailing regulation.In order to meet the diversified needs of the public in travel,deepen the transformation reform of taxi industry,standardize the operation and service of online car-hailing,and protect the legitimate rights and interests of passengers and operational safety.In July 28,2016,the 7ministries,such as the Ministry of transport and the Ministry of industry and commerce,made clear for the first time the legal status of Internet related vehicles at the level of national laws and regulations.At the same time,the entry requirements of drivers,vehicles and network operation platforms were clearly defined.All parts of the country have started the reform of the taxi industry,and Rizhao City Government formally promulgated the Interim Measures for the Management of Online Car-hailing Operations and Services in Rizhao City in 2017(hereinafter referred to as the Interim Measures).This paper focuses on the safety and compliance issues in the regulation of online car-hailing,combining with the characteristics of the times of the development of the online car-hailing industry.At the same time,it makes a case study in the light of the actual situation of Rizhao City.Rizhao has a relatively small volume and fast development speed.As a tourist city,Rizhao has a better development prospects.However,there are a lot of regulatory problems in Rizhao's online car-hailing industry,which restrict its regular and orderly development.Firstly,the functional orientation of regulatory agencies is not clear.The maintenance pressure and regulatory capture of the traditional taxi industry have affected the regulation of the online car-hailing,further affecting the regulatory effect.Secondly,the concept of the regulation mechanism of online car-hailing is rigid and self-confident,and it is fearful of new things.Thirdly,the regulatory process lacks certain legal procedural constraints,the hearing process,and the appeals of stakeholders have not been reasonably expressed.Finally,Rizhao City's online car-hailing regulation means are insufficient and the implementation effect is poor.The mainreasons are that the institutional inertia of regulatory agencies is large,there is path dependence in the choice of regulatory means,the legal basis of regulatory process is weak and the regulatory object is complex.In order to study the regulation of online car-hailing in Rizhao City,this paper combines with the actual situation of Rizhao City,using literature collection,questionnaires,field interviews and other methods to analyze the regulatory effect and improvement space of the online car-hailing industry in Rizhao City,and puts forward some countermeasures for improvement.First,proceeding from the public interest,we should accelerate the transformation of government functions and the process of institutional reform,strengthen the honest defense line and supervision system of regulatory agencies,and take strong measures to reduce the occurrence of regulatory capture.Secondly,we should innovate the concept of regulation and optimize the service,reduce the access conditions of the online car-hailing industry appropriately with an open mind,and promote the integration and development of online car-hailing in a larger pattern.Thirdly,we should establish and improve the procedures for formulating regulations on online car-hailing,conduct hearings extensively to draw opinions and suggestions,and incorporate government regulation into judicial review,delimit the boundaries of regulatory responsibilities,and enhance the management capacity of the industry.Fourthly,we should explore ways to establish supervision suitable for the Internet age,increase investment in science and technology,consolidate corporate responsibility,actively introduce competition,invigorate the local market,skillfully use the market to fill the gaps in the regulation system,and make good use of the news media and public opinion to make up for the loopholes in government supervision.The research on the regulation of online car-hailing in Rizhao not only provides new ideas and plans for the current problems faced by the online car-hailing industry in Rizhao,but also provides suggestions and relevant references for other cities in the country.
