Salary collective consultation system is under the restriction of national relevant laws,workers' representatives and business representatives in salary distribution system,payment method and equal consultation treatment items,and on the basis of this decision laborer salary and wage agreement of a kind system.This system is the cornerstone of the labor law system and an important way to deal with labor relations and safeguard the legitimate rights and interests of workers.In terms of legislation,the state has made clear provisions on the content,consultation procedures and subjects of the wage collective bargaining system through a number of laws.In terms of practices in various regions,the collective salary consultation system has been basically implemented in all regions of China in recent years,and the number of enterprises and workers covered by the special collective wage consultation agreement has been increasing year by year.But in the process of running the system,the unions independence is not strong,enterprises fail to fulfill its legal obligations of consultation in accordance with the law.This article through to the implementation of the collective wage consultation system present situation and the analysis of existing problems,and according to the actual development of our country to draw lessons from western developed coumtries have achieved good achievements,so as to further improve the salary collective consultation system of our country.In this article,therefore,according to the salary collective consultation system in our country arises the problems,we should from improve the dispute settlement mechanism as well as businesses,labour unions and the groverment's obligation and responsibility to improve the aspects put forward some suggestions,in order to realize the system of salary collective to solve the comflict of relations,protect legitimate rights and interests of workers and social stability. |
