Collective Wage Consultation System Under Study

Collective bargaining is the system designation to adjust the labor relations, and it is particularly important for the harmonious of labor relations. This article, on the basis of introduction and study to the collective bargaing system, expounded the meaning of collective negotiations. To investigate the value of the system, the article try to establish the value system as the law, which contain justice, equality, efficiency, order and development. Section II of Part I is about the current state of the collective bargaining system of wage, which is mainly about the participants, process, the rights and obligations.The second part focuses on the jurisprudence of collective bargaining of wage, with the social relationship and good governance by the government are the main points. For the social relationship, I tried my efforts to explain the new market participants, the Game between labor and capital, collection and expression of the workers'interest, the changes of workers'status and the expression for the human rights. By the good governance of the government, this article proposes that the Government should play a role with the labor resources, equal protection and care for disadvantaged, supplying legal resources, construction the coordination of social consensus and be neutral.The third part is the analysis of the system, which is mainly about the problems and Countermeasures. In the analysis of the problems, it is about the subject and market, business owners attitude, the inclination of the Government and the deficiencies of legal protection. In response to these problems, the paper proposes a legal path for the system of collective bargaining for wage, that is to improve labor market, exert the government functions, strengthen functions of trade union and strengthen the legal system.
