Food safety concerns the health and safety of everyone,involves the vital interests of thousands of families and every member of society,and has become one of the topics and hotspots of common concern among the people of the country.At the top of the food chain,catering food safety is more likely to attract people's attention.The administrative punishment is one of the means to effectively punish and prevent food safety violations of various catering services.However,the existing food safety laws and regulations and system rules lag behind the law enforcement requirements of food safety administrative punishment for catering services;Because of the accumulation,immediacy and difference of food and beverage,and the law enforcement team have weak strength and weak legal awareness.the food safety law enforcement team in the early stage of institutional reform has weak strength and weak legal awareness,The powers and other circumstances make the effect of administrative punishment deviate from the expectation of legislative purposes.At the same time,it lacks a relatively complete food safety administrative punishment supervision mechanism and legal remedies,which makes the administrative punishment power of the administrative organs not effectively controlled,and the administrative counterparts' rights are also Not guaranteed.Therefore,in order to solve the food safety problem fundamentally,the research on the administrative punishment in the food safety supervision of catering service is extremely urgent.Based on the theory of public management,government under the rule of law,and the rights protection,this paper analyzes the administrative punishment of food safety in food service by literature research,empirical research and comparative analysis,and finds out the problem of administrative punishment of food safety in food service.The reason is to propose countermeasures and suggestions for improving the food safety administrative punishment of catering services,and lay a certain governance foundation for the food safety supervision and law enforcement environment.The essay contains five parts.The first part is the introduction.This paper mainly expounds the research background,significance,ideas and methods,and reviews the research literature at home and abroad.The second part is an overview of administrative penalties in food safety supervision of catering services.The basic concepts and characteristics involved in this study,the theoretical basis of the study,the system and types of administrative punishments,and the legal basis for the application are discussed.The third part is the analysis of the administrative punishment and the reasons in the food safety supervision of catering services.In this part,it mainly analyzes the causes of problems from the aspects of legislation and system design,law enforcement effectiveness,supervision and accountability mechanisms and legal remedies.The fourth part is the experience and reference of domestic and international food safety administrative punishment.Through the evaluation of foreign countries such as the United States,Germany,Japan and other countries,the advanced experience of food safety administrative punishment,and draw the enlightenment of the food safety administrative punishment measures for catering services that China can learn from.The fifth part is to improve thecountermeasures and suggestions for food safety administrative punishment of catering services.It mainly proposes specific countermeasures and suggestions from the aspects of perfecting the laws,regulations and system of catering service food safety,strengthening the construction of law enforcement teams,strengthening the protection of relatives' rights and creating a public participation in food safety governance.
