Research On The Different Rights Of Villagers In The Same Village Under The Background Of Land Rights Confirmation

The systems of rural land of today's China have undergone a reform from the land ownership by farmers in the early times of China's foundation to the collective credit cooperatives of Socialism Rebuilding period to "the large in size and collective in nature" of People's commune period,Then,the "three levels of all and the team as the foundation" of after reform.The systems of rural collective land based on household contract responsibility system plays an important role in the improvement of productivity.However,the relation changes with man-land relation.Together those form the inequality between the villagers enjoy the same between different individual's village land rights,such as,the household-based land contract system,the policy design of the land contracting relations maintains long-time invariable and,operating rules of respect the status quo of land in the process of land ownership confirmation.This dissertation provides a perspective from land rights and registration of the land contractual management right,which analyzed original intention of policy,execution of policy and,effects of policy from the macro perspective the land right and registration.In the next place,it dissected forms and cause of the issue that is the different right of in the same area of the land contractual management right in the micro perspective.Thus,I draw the three main conclusions from the paper: First,the different right of in the same area of the land contractual management right are the reflection of the conflict between the perspective of land management and the perspective of individual rights of villagers in the reform of macroscopic perspective.Second,it also reflection the deviation from the land property and social attributes.Third,the different right of in the same area of the land contractual management right is directly reflected in impracticable by the strengthening of rural land contractual management rights and the rural land ownership.Furthermore,focusing on improving rural governance from realizing collective land ownership and improving the realization of collective membership rights,thereby,the policy proposal of the different right of in the same area of the land contractual management right has been proposed,and it is resolved.
