At present,under the dual pressure of environmental protection and economic development in China,“green and innovative” has become the “new normal” of economic development in China's economic transition period.Faced with resource shortages and market competition incentives,innovation is the only choice for enterprises to get rid of backward and polluting extensive industrial production methods,increase market share,adapt to economic globalization,balance environmental protection and economic growth,and even achieve "win-win".Due to the externalities of innovation and the public nature of environmental protection,market regulation is prone to failure,and the government must act as a leader to guide and regulate the market.According to China's actual national conditions,the state has unified laws and regulations,and local governments are responsible for the specific implementation and implementation of policies.However,due to regional heterogeneity and the “official promotion competition” of local governments,the implementation of policies in different regions is different,and the innovation performance is different,which in turn affects the entire country.In recent years,local governments have used a large number of means and methods to guide and stimulate managers when dealing with the contradiction between environmental protection and economic growth.In terms of environmental regulation,the government usually uses administrative means and economic means to constrain the production and management activities of the managers,which in turn creates a "detrusive effect" on the enterprise,prompting the innovation subject to choose innovation,and then generate innovative output,intellectual property protection policy.In order to play its role,that is,the right to be insured.In addition,subject to environmental regulations,the burden on enterprises will increase,and the government should protect the legitimate rights and interests of innovative entities,strengthen intellectual property protection,ease the burden on enterprises,and thus create an “encouraging effect”.In order to study the impact of local government environmental regulation and intellectual property protection on regional innovation capabilities,this paper has done the following work:Firstly,the definition and elaboration of the relevant concepts in this article will lay the foundation for the later thesis.On this basis,it analyzes the status quo and problems of China's government environmental regulation,intellectual property protection and regional innovation capability,analyzes the importance of environmental regulation and intellectual property protection under the government's leadership on regional innovation capability,and emphasizes the regulation of government environment.The need to combine the “constrained effect” with the “encouraging effect” of intellectual property protection.Secondly,from the "Eleventh Five-Year Plan" in 2006,the country listed "energy-saving emission reduction" as a constraint indicator for the first time in the national economic and social development planning plan,and in-depth implementation of the national medium-and long-term science and Outline of Technology Development Plan(2006-2020).The environmental protection and intellectual property protection of China's national and eastern,central and western governments in the past decade,and the impact of the two and the joint implementation on regional innovation capabilities.Through empirical tests,the conclusions are drawn: First,on the whole,in terms of government environmental regulation,China's government environmental regulation and regional innovation capability are not simply linear,showing a “U” relationship.Second,from the perspective of the eastern,central and western regions,the overall administrative punishment,government scale and pollution control in the government's environmental control have positive effects on regional innovation capabilities,but their effects in different regions are different.Third,from a nationwide perspective,the “constrained effect” of government environmental regulation and the “encouraging effect” of intellectual property protection are simultaneously implemented,and the two-pronged approach can better promote the improvement of regional innovation capability,but at present the induction of both is insufficient.Still need to be strengthened.Fourth,from the perspective of enterprise survival,government environmental regulation must be in a moderate range,so as to better play the synergy between its intellectual property protection and environmental regulation.Based on this,the paper analyzes the threshold effect,further studies the impact of government environmental regulation on the threshold effect of intellectual property protection,and finds the specific threshold.However,from the empirical results,the environmental control of the government in most areas of China has not been controlled within a reasonable range and needs to be strengthened.Finally,based on theoretical analysis and empirical tests,reference is made to the experience of the United States and Japan in government environmental regulation and intellectual property rights,and proposes corresponding policy recommendations for China's specific national conditions and regional heterogeneity in the eastern and central regions.At the same time,on the basis of summarizing the main research results of this paper,the shortcomings of this research and the future research focus are pointed out.
