Research On The Property Right Change Of The Relationship Between The Whole Village And The City

As a product of China's social transformation,relational property rights widely exist in the operation of China's rural collective economy.It is the core and fundamental of the rural collective property right system to clarify the relationship property right.Because of the first mock exam,the definition of collective property rights in China is unclear and unclear.This blurred state leads to a game of multi parties in the process of collective assets allocation.As a different interest entity,villagers,village collectives and governments show different positions and views on the change of relationship property rights,and many laws are involved in the game of distribution results.In this paper,H Village in Northeast China is taken as a case study,and a process event analysis method is used to reproduce the process of clarifying the relationship property rights of a Chinese rural village in the social transformation.In the study,the author found that the new relationship property rights formed after the rapid changes of the social structure of the village,the ownership of the villagers is virtual.During the ten-year development of H Village,the villagers did not enjoy the dividend of the development of the collective assets of the village.After the interests of the villagers were damaged,they launched a revolt,pushing the redefinition and clarification of the relationship property rights of H Village.Through reflection on the whole process,the author finds the following points: first,the process of clarifying the relationship property right,which is the essence of the villagers' appeal;second,throughout the whole game process,the villagers always do not have the leading power of event development,the multi-party participation process after the intervention of the Chinese forces fails to fully clarify the relationship property right,the government reduces participation,and the city Field intervention is a feasible way to clarify property rights.Finally,as a product of social transformation,the rules of relationship property rights in the process of change are uncertain.We should prevent the village elites from encroaching on the village collective assets,protect the villagers' rights and interests during the transformation period,and give full play to the development advantages of the village collective economic organization as a community.Through the reappearance of the process of clarifying the relationship property rights,this paper preliminarily clarifies the role played by the villagers,the village collective and the government in the process of changing the relationship property rights,which lays a foundation for the correct understanding of the conflicts in the distribution.At the same time,in the internal game of the village collective organization,we can see that the local government is of great significance in the change of property rights of the relationship.
