Effectiveness As The Standpoint And The Construction Of Land Proper System Of Contemporary China

Distinguished from existing literatures which commonly relate the distinctiveness of contemporary Chinese land property system to the particularity of our institutions of politics and law,this paper sets a new perspective which emphasizes the characteristics of its making process itself.And the latter mainly refers to the nondeterminacy of the rules in land system and the ambiguous relationship between the state and property,while the former mainly refers to the standpoint of effectiveness taken by the revolutionaries when a new property system was introduced in.The paper mainly focuses on the merging of land issue in the early 20^thh century,different proposals of land reformed submitted by revolutionaries with different political beliefs and how were these schemes were put into practice under the specific circumstance of that society.The introduction part of the paper mainly discussed the origin of the research topic,the existing literature and my approach of research.In chapter 2,the merging process of the land issue is discussed,especially about how it became one of the most popular topics among intellects at the ending of the 19^thh century and begging of the 20^th.It is emphasized here that the arising of the problematique of land issue itself is the very result of a careful searching for the causes of the crisis by the Chinese people at that time.Hence the identification of land issue comes from the consideration of effectiveness on the future of our nation on the one hand and the consideration that only by revolution can the“total crisis”be solved on the other hand.Then two main proposals of land reform are further discussed in chapter 3,that is,the proposal from SunYat-sen and that of the CCP.It is pointed out that both of the ideas were once challenged by other thoughts on property.While the emphasis on the effectiveness of land reform is the common ground of the two,Marxist scholars like Chen Hansheng did make a much further and comprehensive analysis of the land system,thus gaining much greater influence and approval by the society.This made the land issue and the Marxism viewpoint about it a hot topic at that time.And then the following chapter continued with the analysis of the previous one,especially focuses on the practice of the two different proposals of land reform with effectiveness as their standpoint for both.After that,the last chapter makes conclusion of the paper which summaries the decisive effect of the standpoint of the introduction of the new rules of property system.It is believed that the process of making of a modern state greatly limited the selections of the rule of property.
