On The Perfection Of The Legal System Of River Chief System In China

The system of river chief is a problem oriented system,and it can also be said that the system of river chief is a system developed from practice.Practice is the core of the system of river chief.To perfect the system of river chief,we can’t do without the empirical study of its implementation.This paper adopts the method of empirical research,combined with the current situation of the practice of the river head system in Sichuan Province,through case analysis,discussion,field investigation,etc.,to provide an empirical vision for the construction of the rule of law of the river head system.In order to realize the empirical analysis of the river head system in Sichuan Province.Firstly,through the environmental information disclosure data of Sichuan Provincial Department of ecological environment,the data of surface water quality change and lake water quality change in Sichuan Province were obtained.Combined with the time when Sichuan Province formulated the implementation plan of "opinions on comprehensively implementing the river chief system" in Sichuan Province,the corresponding data samples are selected to realize the data analysis of the implementation effect of the river chief system.Secondly,case analysis is carried out.The W District selected in the case,because of its natural location advantages and traditional context,is a region with solid economic foundation and better implementation of river head system in the province,which has considerable practical significance for improving the system design of river head system.C city is brought into the perspective of case study because of its innovative design in the field of environmental justice combined with the practice of river head system,in order to provide more thinking angles for the improvement of river head system.The sample of empirical analysis includes both the central city of megalopolis and county-level cities,taking into account the representativeness and diversity of the sample.Finally,the river chief system is a problem oriented system,which should be adhered to in practice.The author found that there are still some problems in the system improvement,supervision mechanism and public participation.China’s existing water resources management system is a "bureaucratic" system design,the division of administrative power,on the one hand,brings the advantages of each department to perform their duties;on the other hand,on the other hand,there is also the institutional dilemma that the water environment is difficult to be effectively managed.With the emergence of "river head system",the main responsible persons of the party and government in various places act as the river head to undertake the overall planning and communication of local water resources governance and coordinate the governance efficiency of various departments.To a certain extent,it solved the dilemma of multi department collaborative governance of water environment.However,through the empirical study of the river head system,it is found that there are some problems in the river head system,such as the imperfect legislative guarantee,the imperfect institutional arrangement,the unclear assessment and accountability mechanism,and the blocked channels of public participation.In order to avoid the effect of river and lake governance,to achieve good law and good governance,and to meet the beautiful needs of the people,this paper,based on the investigation and practice of the implementation of the river head system in Sichuan Province,puts forward some suggestions for the improvement of the river head system,such as clarifying the system design of the river head system,strengthening the accountability mechanism of the river head system,and improving the public participation of the river head system It will contribute to the legalization,standardization and institutionalization of the river chief system.
