Study On Risk Management Of Construction Contract Of A Construction Company

The modern construction project is large in scale and high in complexity,so there are more potential uncertain factors in the process of the project.Facing the complex construction environment and construction conditions,how to standardize the construction contract,reasonably control the risk of the construction contract,and improve the risk management level of the construction contract has become the key and difficult issues for the construction enterprises.The construction contract has a long period and a complicated content,which involves the rights and obligations of the employer and the contractor.The construction enterprise should apply the risk management theory to scientifically identify the risk,evaluate the risk and then deal with the risk.This paper takes a construction company as the Research Object,investigates and studies the present situation and existing problems of its construction contract risk management,according to the types of contract disputes that a company has encountered in the past five years,the list of risk factors of a company’s construction contract is made,the risk evaluation system of construction contract based on analytic hierarchy process(AHP)is constructed,the experts are invited to grade and the probability and influence degree of each risk factor are calculated quantitatively.Finally,the main countermeasures of a company’s construction contract risk management are put forward from three aspects: Risk Elusion,risk control and risk transfer.The conclusions drawn from the above work are as follows:(1)Through combing the organization structure and process of a company’s construction contract risk management,it is found that there are some problems in the construction contract management of a company,such as the lack of legal consciousness,the lack of dynamic contract risk management and the low attention to contract risk management.In combination with the types of contract disputes in the past five years,it is found that the proportion of construction contract disputes is the highest,thus confirming that more attention should be paid to the risk management of construction contract,and the risk management theory should be actively applied to identify and manage the risk of construction contract.(2)According to the type of risk disputes in construction contract of company A,the risk list of construction contract is drawn up,which includes 7 risk factors.The experts were invited to grade the risk factors by questionnaire,and the risk evaluation index system of construction contract based on AHP was established.(3)Using analytic hierarchy process(AHP),the experts are invited to judge the importance of the factors in risk list by questionnaire,and the probability of each risk factor is obtained.The study shows that the contract execution stage is an important stage in which the construction contract risks occur frequently,and it is also a key stage which should be paid more attention to.Among the seven elements of wind direction,the risk of acceptance and completion,the risk of start and stop,and the risk of contract price form are relatively high,which should be paid more attention to,and the risk of construction safety is the lowest,this benefit from a company for a long time more perfect safety operation system and training system.(4)According to the result of risk evaluation of a company’s construction contract,this paper expounds the concrete countermeasures of strengthening the management of construction contract,reducing the risk of construction contract and reducing the disputes of construction contract from the angles of risk evasion,risk control and risk transfer.
