| The procuratorial supervision mode of the supervision institution refers to the legal supervision mode established by the people’s procuratorate in order to ensure the legality of penalty execution and related supervision activities.Article 16 to article 19 of the organic law of the people’s procuratorates of the People’s Republic of China divides procuratorial supervision in places of supervision into four types: dispatched procuratorial supervision,roving procuratorial supervision,inspection inspection and special procuratorial supervision.Moreover,the organic law of the people’s procuratorates was passed on October 26,2018,which means that the mode of circuit inspection has been recognized at the legislative level.Under the mode of procuratorial supervision combined with circuit inspection and dispatched procurators,prisons,police stations and other places of supervision can be effectively supervised.The method of procuratorial supervision mainly based on Posting has been used for a long time since the implementation of procuratorial supervision of supervision institutions in China.Although this method has played a good effect in procuratorial supervision of supervision institutions,at the same time,it also produces a series of problems such as looseness and immobilization of supervision personnel,which greatly reduces the quality of supervision.Compared with the dispatched procurators,the roving procurators have higher mobility and sensitivity,which can timely correct the illegal phenomena in practice and better protect the rights of citizens.Only in this form can the educational reform be more conducive to the formation of law-abiding citizens.However,there are some problems in the roving inspection,for example,the scope of application is small,the timeliness is relatively weak compared to the stationed inspection,and the roving inspection affairs in practice are relatively tedious and miscellaneous.Although the system of inspection and supervision of supervision institutions has developed,there is still room for improvement.The author will focus on the supervision of the supervision of the prison,based on the supervision of the supervision of the procuratorial organs,from the present supervision of the supervision of some problems to analyze,combined with the author’s practical work,to improve the supervision system of the execution of some exploration.Here,the author hopes to make the mode of inspection and supervision more perfect and the setting of each link more reasonable through analysis and comparison.Secondly,it is hoped that people’s procuratorates can supervise supervision sites and strengthen human rights protection of detainees by exploring a better mode of supervision.Finally,I hope tomake some contribution to the progress of our country’s judicature and the promotion of justice. |
