Research On The Political Function Of The Political And Law Committee From The Perspective Of Structural Functionalism

The report of the 19th CPC National Congress pointed out that "Uphold the organic integration of the leadership of the Party,the position of the people as masters of the country,and the rule of law is an inevitable requirement for socialist political development." The Politics and Law Committee has effectively implemented the party’s ideology,guidelines,and policies to the political and legal organs.It has not only realized the party’s absolute leadership over political and legal work,but also ensured the organic unity of party leadership and rule of law.As an important organizational carrier of the party’s political and legal system,the Political and Law Committee is a functional department leading and managing the political and legal work of the party committee.The interactive relationship between the party committee,the political and legal committee and the political and legal organs is the epitome of the party-government relationship in China.Through the investigation of the political function of the political and legal committee,it can provide demonstration for the necessity of the party leading the political and legal work.However,the current research fails to theoretically clarify the political positioning and superiority of the Political and Legal Commission in national governance.Therefore,scientifically expounding the position of the party committee’s political and legal committee in the national power structure,and in-depth discussion of the political function of the party committee’s political and legal committee,and clarifying the boundaries of its organization and operation are not only an important topic for promoting the modernization of national governance capabilities,but also important for maintaining judicial justice.From a historical perspective,the practice of the party’s management of political and legal organizations is the foundation for the formation and development of the political and legal committees.The historical changes of my country’s Political and Legal Committee have gone through six stages: the organization preparation stage,the organization formation stage,the tortuous development stage,the restoration establishment stage,the consolidation and perfection stage,and the maturity stage.The formation and development of the Political and Legal Committee has been affected by the changes in the relationship between the party and government and the transition from politics to the rule of law governance.From the initial deliberative and coordinating agency,it has gradually evolved into a functional department leading the political and legal work of the party and the coordination and overall planning of social governance.Institutions are party-government complex organizations that have the dual attributes of party leadership and social governance.According to the influence of changes in the attributes of political institutions,this article uses structural functionalism as the analytical framework,abstracts the Political and Law Committee as a political structure in the operation of the party-government system,and analyzes its functions in the operation of the party-government system.Based on this,the Political and Legal Commission plays the functions of organizational management,political communication,political integration and political supervision at the system level,process level and policy level in the operation of the party and government system in contemporary China.However,at present,although the Politics and Law Commission has irreplaceable advantages in China’s national governance,there are also distorted public opinions and confusion in the expression of interests in its political functions.Weak political and legal supervision,formalism and unclear management rights of co-management cadres have affected the effectiveness of the political and legal committee in the party-government complex system.The principle of democratic centralism must be adhered to.Establish a strict and effective political supervision mechanism,strengthen the political and legal committee to coordinate the responsibilities of cadres,improve the social security governance model that combines "movement" and "convention" to improve it.
