A Constitutional Analysis Of Family Members′ "Identity Attachment"

The system of “identity attachment”among family members in China has a deep historical foundation.In the contemporary era,it depends on Chinese political review system,showing a variety of ways and types.However,in a modern country ruled by law,there is no doubt that the risk of institutional discrimination and abuse of power exists,which makes the construction of national governance and the rule of law face challenges and infringes the basic rights of citizens.In order to solve these problems,we should return to the angle of constitution science,analyze the concrete manifestation and problems of the family members’ “identity attachment”in the current national governance practice,and put forward the reform suggestions and perfect measures in the light of the system defects.This paper begins with a case to clarify the basic concept of family members’ “identity attachment”.This paper reviews the historical evolution from the“Lian Zuo”system to the party admittance review,reviews the origin,strengthening and continuing stages of the family members’ “identity attachment”system,and probes into the historical evolution and intrinsic motivation behind the system.Then,focusing on the contemporary types of family members’ “identity attachment”,identifying the concrete manifestations of“opportunity-attachment”and“ power-abusing-attachment ” Identity attachment,and exploring the logic of system design under different circumstances,the institutional thinking of family members’ “ identity attachment”may face such legal risks as infringement of citizens’ basic rights,deviation from the traditional imputation principle and lack of relief mechanism.Finally,it returns to the constitutional reform of the family members’ “ identity attachment ” system,clarifies the rationality of the family members’ “identity attachment”system under some special occasions,and emphasizes the reality legitimacy based on the protection of private rights,on the basis of learning from the experience of foreign countries,this paper puts forward some suggestions on the path of the reform of the current identity attachment system from the perspective of the basic principles of the Constitution.
