| With the development of the world economy,it is a consensus construction aspect of civil servants worldwide to raise the moral norm to the legal norm by making a law.This consensus is original from the reason that under a conflict of interests,the civil servants’ defense line that adheres to professional morals so vulnerable to challenges,leading to many moral dilemmas.In practice,the phenomenon of professional morals failure of civil servants in our country occurs frequently and presents an increasingly serious trend.Therefore,it is one of the important tasks for promoting the professional morals of civil servants in China.However,as a soft constraint,professional morals may lead some civil servants to establish their minds in abiding professional morals to a certain extend.This kind of moral constraint is useless for other civil servants,especially with low moral literacy,due to the lack of compulsory protection.Thus,in the construction of the country and government ruled by law,it is an urgent problem to be solved to supervise the civil servants’ work by law and regulate their professional morals by a legal mechanism.By building professional moral legislatively,the civil servants’ can not only urge to comply with the limitation of professional moral obligations with legal coercive force,but also the professional moral of the overall group are promoted significantly,promoting the construction of rule country and government by law.In this work,to study legislating a law for civil servants in China,the common theory should be discussed first.Based on the concept and content of civil servants’ professional moral in the general theory,the analysis of the necessity of legislation is done.Secondly,the present situation of China’s civil servants’ professional moral legislation is examined in an empirical dimension.At present,professional moral legislation is mainly stipulated by legal regulations and party discipline regulations,which means that the current legislation is still at a low level.There are problems with an unsystematic legal system,incomplete legislative content,and inadequate supervision mechanisms.Thirdly,after analyzing the problems of current civil servants’ professional moral legislation in China,the legislative experience and enlightenment of the developed countries are sorted out.These developed countries including the United States,the United Kingdom,and Japan,which much experience can be obtained in the legislative system and content system.For example,they have built a complete legislative content,established a multiple supervision mechanism,and provided various skills training.Finally,regarding the existing problems in China’s professional moral legislation,based on the problem-oriented and theory-guided way,the advice of improving professional morals should be proposed in the following three aspects:improving the legislative system,improving the content of legislation,and improving the supervision mechanism. |
