The preschool education has always been an important part of the education systems by the comprehensive survey of the various educations in the world. It is not only the foundation and the key to the development of each social individual’s life, but also the foundation engineering to enhance the competitiveness of the national human resources. Attaching importance to the development of the preschool education is a common trend in the world today. In our National Medium and Long-term Education Reform and Development Plan Outline(2010-2020), the preschool education is regarded independently as the modern national education system and should be promoted by the governments. However, our current preschool education legislation seriously lags behind while the development of the preschool education has been in great need. Therefore, we should make a careful study of the preschool education legislation so as to improve the theory of the preschool education legislation, guide the preschool education legislation practice, stipulate the government’s powers and responsibilities, make the rights and obligations of the other parties. In this way the preschool education legislation may be scientific, reasonable, prospective and effective in order to provide the legal protection for the better development of the preschool education.This thesis is divided into four parts: The first part defines the concepts of the preschool education and the preschool education legislation, expounds their characteristics,significance and different views on the preschool education legislation, then analyzes the necessity and feasibility of the preschool education legislation; The second part analyzes the current situation and problems of the preschool education and preschool education legislation in our country; The third part discourses upon the value orientation and basic principles of the preschool education legislation; The fourth part, on the basis of the successful experience of the other countries, with the domestic reality, has put forward the specific countermeasures for the preschool education legislation. Finally, the Proposed Draft of Preschool Education Law of People’s Republic of China has been made on the basis of the previous study of the preschool education legislation by the author.
