Research On Legal Issues Of Grain Regulation

Hong Fan was the leader of the eight administrations,food problem is the top priority of government.As China’s food problem a top priority,food security is also related to national security,food regulation is a necessary means to ensure food security.For a long time,China’s grain policy has been used to regulate food,but excessive dependence on regulatory policies and government forces makes the policy arbitrary and chaotic,hinders the development of market economy,and is not conducive to ensuring food security.In recent years,the economic situation is grim,the grain price is rising,the import of Foreign Trade grain is unstable,and the risk of food security crisis is increasing,which requires a more perfect grain regulation system to deal with the risk.The law is of great significance to the improvement of the grain control system and the guarantee of food security.The legal system of grain regulation and control in China is not complete,which is manifested in the following aspects: the provisions of grain regulation and control in the current laws are unclear,the relevant laws of regulation and control exist conflicts,and the legal responsibility is not clear.Therefore,it is of great significance to improve the legal system of grain regulation and realize the legalization of grain regulation and control to ensure China’s food security.This paper mainly uses the methods of literature analysis,historical analysis,comparative analysis and normative analysis to elaborate and analyze the theoretical support and existing legal problems of China’s grain regulation.Based on the investigation and reference of foreign experience in the rule of law of grain,this paper puts forward some suggestions on improving the rule of law of China’s grain regulation.In addition to the introduction and conclusion,the text is divided into the following four parts:The first part,on the basis of clarifying the necessity of grain regulation,starting from the basic connotation of grain regulation,the theoretical basis of grain regulation is analyzed.The second part,by combing China’s grain regulation policies and combining with the legal status of China’s grain regulation,the problems existing in the implementation of grain regulation are put forward.There are some problems,such as the lack of food regulation legislation,the lack of understanding and attention of food production regulation,the poor convergence of food circulation,the central and local game of food reserves,and the lack of food consumption laws.In the third part,the United States,Canada,Japan and India in the food regulation and control of the legal system is sorted out,clear the direction of the legal system construction of each country,and extract the experience worthy of China’s reference.In the fourth part,in view of the existing problems in the legalization of my country’s food regulation,we fully learn from foreign experience and combine the requirements of my country’s food security to put forward perfect suggestions for the legalization of food regulation.The first is to improve the legislation on food regulation in the "Grain Law(Draft for Review)",and provide suggestions on the basic connotation,subject,object and regulation behavior of food regulation.The second is to improve the legal connection between grain control and grain production,circulation,storage,and consumption.The third is the fulfillment of responsibilities in food regulation and control,which are improved from the three aspects of economic accountability,social responsibility and litigation of food regulation.
