The Research Of Legal Regulation On Natural Gas Price

Under the background of comprehensively promoting the rule of law,how to legalize various government regulation measures is a subject worthy of in-depth discussion.This paper studies the legal regulation of natural gas price,which is representative in government regulation,and has guiding significance for the legalization of government regulation measures in other fields.Natural gas,as a national strategic resource,is not only the main force for the replacement of industrial energy,but also the fuel required by People’s Daily life.Therefore,the normal supply and price of natural gas are closely related to millions of households.Since the construction of East-West pipeline was launched in 2000,after more than 20 years of continuous efforts,the proportion of natural gas in China’s primary energy consumption has been increasing,and with the continuous promotion of comprehensive deepening reform,China’s market-oriented reform of natural gas price has made progress.By the end of 2019,the price of natural gas gate stations has been removed from the Central Pricing List,and the State Oil and Natural Gas Pipeline Network Group Co.,Ltd.has been listed and established,indicating that the market-oriented reform of natural gas price "freeing both ends and controlling the middle" has fully met the conditions in practice.At the same time as the construction of East-West pipeline,Chinese government regulatory departments and theoretical circles started the research on the regulation of natural gas prices,mainly by learning from the regulatory experience of western developed countries and combining it with China’s actual national conditions.Although some research achievements have been made,theoretical,systematic,and guidance of natural gas price regulation is not strong.Moreover,it is mainly analyzed from the perspective of economics,and there are few research achievements on legal regulation.In the field of western economics,government regulation is a concept corresponding to market competition mechanism.After the enactment of the anti-monopoly law,regulation was gradually brought into the field of law research,and with the development of economic theory,legal regulation theory is also developing.From advocating free competition to government intervention in the economy,from structuralism to behaviorism,and then to the current new industrial organization theory of incentive regulation,the capitalist countries still pay attention to the coordination with government regulation and market competition mechanism,we no longer need to question the government intervention in the economy,but should focus on how to bring government regulation into the rule of law track.This paper reviews the influence of economic theories on regulation practice in western countries,finds the theoretical basis of legal regulation of natural gas price,and summarizes the constituent elements of legal regulation from the point of connection between regulation and law,sorts out the relevant systems of natural gas price regulation.It summarizes the problem of natural gas price law regulation in our country,puts forward the suggestions for the perfection of natural gas price regulation legal system in China: one is the perfect gas price regulation legislation,including perfect anti-monopoly law and price law and related regulations of natural gas price regulation,start the oil and natural gas law legislation,etc.;Second,improve the law enforcement procedures of natural gas price regulation,including setting up a professional natural gas regulatory agency,optimizing the formation mechanism of natural gas price,and ensuring the decentralization and coordination of regulatory agencies.Third,we should improve the system of checks and balances of natural gas price regulation,including the franchising system,price hearing system and information disclosure system.
