| In the 1990 s,the housing system began to carry out market-oriented reform,opening the historical process of housing privatization.With the development of real estate industry and the enhancement of residents’ willingness to buy property,more and more residents live in urban commercial housing residential areas.Community residents demand diversity of types diverse,feature request property companies to provide matching services,and in reality,however,the owners of the community property conflict,arguments and even physical reports emerge in endlessly,the conflict is rooted in the early system design to promote the development of the real estate industry,and safeguarding the rights and interests of the owner system equipped with no follow up accordingly.The lack of equity in property right structure design leads to an unequal position between the owner and the property.The "monopoly" mechanism in the property industry stimulates the sprout of the owner’s self-governing organization,and the owner committee gradually becomes a topic of public concern.The owner committee this organization was born in the community,based on property rights,can stimulate autonomous vitality,effectively play the function of autonomy.Although the owner committee has developed for more than ten years in China,many communities are still faced with many difficulties.Taking G Community in Hefei City as an example,this paper studies the difficulties in the establishment of owner committees from the following aspects based on the theory of independent governance and rational choice: Chapter1 is the introduction,which comprehensively introduces the origin and significance of the research,basic concepts,literature review,theoretical basis and research methods;The second chapter introduces the establishment background,preparation,election,rapid dissolution and the process of the establishment of the second session of the owner committee of the G community in Hefei City;The third chapter,the analysis points out that the owner authority to set up the dilemma lies in the owner authority to set up the threshold is higher,the establishment of the preparatory work is difficult,the owners meeting conditions are difficult to achieve,the owner authority for the record registration is not easy;The fourth chapter,from the imperfect laws and regulations,owners collective action is difficult,owner authority internal operation is not smooth,property companies do not cooperate,community neighborhood committee and street guidance and support and other aspects of the owner authority to establish the difficulties of the reasons for analysis;The fifth chapter from the improvement of owners committee legal policy,improve owners rational participation consciousness,strengthen the business committee itself construction,enhance the property company management transparency,clarify the relationship between owner committee and neighborhood committee,improve the street guidance and supervision mechanism and other aspects of the countermeasure study. |
