| Community corrections is a non-custodial criminal execution method that focuses on both punitive and restorative crimes.At the end of 2019,the "Community Corrections Law" was formulated and promulgated.Community corrections,as a socialized penalty enforcement method,was formally established in legal form.This is an important advancement in my country’s penalty civilization.There are many references to scientific corrections in the "Community Correction Law",especially the "targeted correction programs","categorized individualized corrections",and "time-based program adjustments based on performance" emphasized in Article 24.The reflection of evidence-based thinking provides a sufficient legal basis for the integration and application of evidence-based correction in community corrections.Under the current criminal policy environment of "leniency and strictness",the local judicial practice of evidence-based correction in the current community corrections in my country has shown a blossoming situation,which is mainly reflected in the standard of evidence-based correction process,the selection and evaluation of correction objects,and the accumulation of evidence selection.On the one hand,all localities have boldly adopted evidence-based correction thinking on the basis of the original community correction system to carry out localized innovations.However,in the process of the application of evidence-based correction in community corrections,many restrictive factors have also been exposed in terms of execution concept,penalty system,participants,program design and supporting support.Looking at the practical development experience of foreign evidence-based corrections in community corrections,it is not difficult to find that foreign evidence-based corrections generally have strict and perfect evidence-based correction principles,advanced technical support and relatively mature practice models,and evidence-based concepts are advanced Scientific concepts have played a unique role in the field of community corrections.In view of this,by drawing on the judicial practice models of evidence-based corrections in advanced countries such as the United States,the United Kingdom,and Canada,based on our country’s reality,we propose a rationalization that is in line with international standards and conforms to my country’s actual national conditions in response to the existing problems in the application of evidence-based corrections in community corrections in our country.Recommendations: Timely change the concept of execution in my country,from "experience correction" to "scientific correction";strengthen the construction of the penalty system of evidence-based correction in community corrections,and provide system guarantees for its application;coordinate with the multi-participants of evidence-based correction to clarify the main body Improve the program design of evidence-based correction in community corrections in our country to avoid the disconnection of procedures;optimize the supporting support for the application of evidence-based correction in community corrections to provide reliable guarantee for its operation. |
