| A good business environment has become a golden sign for attracting investment and developing the economy in various places.The quality of the business environment is related to the survival and development of market entities,as well as the speed and quality of local economic development.At this stage,various localities have reached a consensus on the goal of building a better and better business environment.From the central government to the local governments,they are actively exploring how to optimize and upgrade the business environment and explore new ways for the further development of the economy.To optimize the business environment,policies and regulations go first.The development of my country’s local economy needs to be assisted by policies and systems,and the optimization of the business environment also needs legislation to protect.In view of this,on October 22,2019,the State Council for the first time carried out special legislation on the business environment and promulgated the "Regulations on Optimizing the Business Environment." Prior to this,seven places including Liaoning had already taken the lead before the central government and tried to implement local legislation on optimizing the business environment.After that,other provinces and cities also followed the pace of the State Council.A series of local regulations to implement the"Regulations on Optimizing the Business Environment." In the future,the construction channels of the business environment should show a sinking development,and various places will become the main force in the construction of the business environment,and the advantages and disadvantages of the local business environment will become the magic weapon for victory in the new round of local competition.Therefore,the business environment has an important strategic significance for local development,and the issue of local legislation on the business environment is worthy of further discussion and research.Starting from the proposal and definition of the business environment,this article uses foreign and domestic business environment evaluation indicators as the starting point to study the legislative background,current legislative status,and legislative issues in the current practice of local optimization of the business environment legislation in my country.And based on the author’s own knowledge,I put forward corresponding suggestions on local legislation,hoping to provide some help to the local authorities in the drafting,formulation and implementation of business regulations.The main body of this article is divided into five parts.The first part is an overview of the business environment,which mainly explains the concept of the business environment and the evaluation indicators of the business environment at home and abroad,and provides guidance and evaluation standards for the optimization and upgrading of the business environment in China.The second part is an overview of local legislation for optimizing the business environment,mainly introducing the legislative background and current status of local legislation for optimizing the business environment.The third part is the comparison of local legislation to optimize the business environment.This paper selects 15 provincial local laws and regulations（the deadline is February 28,2021）which are currently effective,and compares them from the macro and micro perspectives.First of all,from the style,form,content and other macro aspects of the general comparative analysis;Secondly,it makes a comparative analysis of the specific elements of the business environment,such as market,government affairs,rule of law and human environment;Finally,it summarizes the commonness and differences of business laws and regulations.The fourth part is about the problems of optimizing the local legislation of the business environment.Through combing the background and current status of the local legislation of the business environment,it discusses some problems in the formulation and implementation of the local business laws.The fifth part is the recommendations for optimizing the local legislation on the business environment,and proposes optimizable recommendations and improved paths for certain problems in the drafting and implementation of the current local business laws and regulations. |
