On The Regulations Of Township People In The Construction Of Rule By Law In China

The Forth Plenum of the 18 th Central Committee of the Communist Party of China has made clear the important role of social self-government norms in the construction of the rule of law, such as village regulations, citizen convention, industry regulations and articles of association of the group. In fact, based on "consent", village regulation which is made by grass-roots members of the community has become the value orientation and action guidelines, mediating social relations and maintaining rural society order. However, today there still exists cultural imbalance phenomenon and the nature of "local society" in some way, which is described by Liang Shu-ming, Fei Xiaotong. In this "half-acquaintance society", even though the modern concept of rule of law and rules bring some impact to the rural society, but morality and custom deeply rooted in the heart of the villagers still hinder the diffusion of conceptions of the rule of law. Compared with that of modern cities, the operation of seemingly universal meaning of "rule of law" in the rural society is unsatisfactory. So, to break this barrier, there is still a need to combine the administrative embeddedness and rural endogenous characteristics of the participation of modern local rules. In the process of construction of rule of law in the country, by analyzing the value of the modern village regulations and deeper-level reasons for many problems, we can find the solution. Combining the modern concept of the rule of law with the rules of order inherent in the country is of major importance to building a new Socialist countryside.This article is divided into four parts, discussing the subject of “village regulations under the construction of the rule of law in the country”. The first part mainly defines the meaning of village regulations by the history, research methods, and cards the historical evolution, and on this basis, clarify the relationship between village regulations and the construction of the rule of law. The second part makes a comprehensive analysis of the theoretical basis of village regulations from the aspect of theory, and deeply analyzes the value meaning of village rules from multi-angle. The third part makes a more intuitive, complete description of the current state of the local rules and the specific problems in the construction of the rule of law in the country by the questionnaire, on-the-spot visiting and the empirical research method, and thus found the limits of local rules themselves, and dug up the root cause for conflicts and contradictions between national law and village regulations. The fourth part is to perfect the possible development of village regulations in the construction of the rule of law in the country on the basis of other parts, which is also the focus and difficulty of this article. This part will contribute to argumentation and building of related systems from the internal and external respectively, in order to maximize the regulatory role of modern village regulations in the construction of the rule of law in the country.
