Research On Problems And Countermeasure Of Land Law Enforcement And Supervision In Meishan Tianfu New Area

Land is the most fundamental material basis for human survival and the basic guarantee for maintaining social stability and sustainable economic development.China’s land area is 9.6 million kilometers,ranking third in the world.Among the land resources,the cultivated land area is 1.951 billion mu,accounting for about 7% of the world’s total cultivated land,and the per capita cultivated land area is less than half of the world average.However,20% of the world’s population has a firm foothold and a secure job on 7% of the world’s arable land,which is a great achievement of world significance.On the one hand,China has a large amount of land resources,but less land per capita and less high-quality land.On the premise of fully ensuring people’s livelihood,the reserve land resources that can be developed and utilized are seriously insufficient;On the other hand,China has complex terrain and many types of landforms,which are mainly reflected in more mountains,less flat land and great difficulty in development and utilization.This reality also shows the severe situation faced by China’s land resources.The specific research object of this paper is Meishan Tianfu new area.The land resource management started late,the relevant systems are not perfect,and the laws and regulations are not perfect,resulting in the failure of land law enforcement and supervision to give full play to the role of land resource protection.Moreover,under the temptation of interests,land violations such as construction without approval,illegal construction,destruction of cultivated land and deforestation occur frequently,and land law enforcement and supervision is also faced with the dilemma of "difficult discovery,difficult investigation and difficult implementation".Therefore,starting from the reality,the paper studies in detail the current situation of land violations in the area,the establishment process of land law enforcement agencies,the construction of law enforcement teams,the main measures taken and achievements in the management of land violations,and summarizes the deficiencies of land law enforcement and supervision in the new area,such as the lack of effective supervision means,the poor operation of system and mechanism,and the difficulty in investigating and dealing with illegal land use.This paper summarizes the countermeasures and suggestions for further strengthening land law enforcement and supervision: First,strengthen supervision by strengthening inspection and using high and new technology to curb land violations in the initial stage.Second,strengthen the construction of relevant mechanisms for land law enforcement and supervision,form a joint force for law enforcement,and ensure the legitimacy of law enforcement decisions while improving the deterrence of law enforcement.Third,strengthen the construction of law enforcement team and constantly improve the discipline,professionalism and enthusiasm of land law enforcement team.Fourth,strengthen the legal system construction of land law enforcement and supervision.We should not only actively publicize land management laws and regulations,but also further improve laws and regulations to make the application of laws more in line with reality.Fifth,we should constantly improve the level of land management and alleviate the pressure of land supply.Sixth,strengthen the independence of land law enforcement and supervision,ensure that land law enforcement and supervision are not interfered,and curb government land violations.Only by taking active and effective regulatory measures can we build the last barrier for the protection of land resources and effectively solve the problem of land violations.Finally,it is hoped that the research in this paper can provide useful inspiration for the future land law enforcement and supervision work.
