Research On Legal Issues Concerning Social Work Service Agencies' Participation In Community Correction

With the promulgation and implementation of the Community Correction Law of the People’s Republic of China,social work service agencies have attracted more and more attention between Chinese scholars,since they play a professional and active role in community correction.For the social work service agencies,that brings valuable development opportunities.However,according to the current development situation,because of uncertain legal position of social work service agencies,regulatory responsibilities between administrative departments is unclear,the level of normalization that the justice administrative departments purchase social work services is not high,the rights and obligations of community correction social workers are incomplete and other problems,the justice administrative departments not very interested in purchasing social work services,lead to difficulties for social work service agencies to participate in community correction.The main reasons are insufficient legislation of social work,and the imperfection of relevant systems for social work service agencies to participate in community correction.This paper takes City F of F province as an example,carry out the problems of purchasing community correction social work services that the justice administrative departments face in practice,summarize the relevant legal issues,and put forward the legal suggestions on the basis of learning excellent domestic and external experiences,to achieve social work service agencies to participate in community correction legalization and standardization.In addition to the introduction and conclusion,the main content of this paper is as follows:The first part: Brief introduction of Social Work Service Agencies’ Participation in Community Correction.By analyzing the legal relationship and basic theory between social work and community correction,the necessity of social work service agencies to participate in community correction is clarified.The second part: The current situation of social work service agencies’ participating in community correction of China.This paper sorts out the present legislative and policy documents situation of the participation of social work service agencies in community correction in China,and generalize the useful experience in practice.The third part: The legal issues of social work service agencies participating in community correction in China.This paper summarizes the problems existing in the participation of social work service agencies in community correction in China,takes F city of F province as an example,and analyzes the legal problems through field visits,interviews and other methods.The fourth part: Investigation on the participation of social work service agencies in community correction that outside borders.This paper studies the legislation and practice experience of the participation of professional social work service agencies in community correction which in the United Kingdom,the United States and Chinese Hong Kong,Chinese Macao and Chinese Taiwan,and tries to find the legal regulation experience worth learning from.The fifth part: Suggestions on the legal regulation of social work agencies’ participation in community correction in China.According to China’s Practical problems of social work service agencies participating in community correction,learning and absorbing domestic and abroad legislation and practice experiences which are useful of social work services agencies’ participating community correction that mentioned above,and make suggestions from establishing the legal system of social work and improve the supervision and management system,improve relevant regulations Community Correction Law,and Clarify the rights and obligations of social workers.
