Research On The Autonomous Norms Of Urban Ethnic Inter-embedded Community Governance

As an urban community,the urban ethnic interwoven community is the basic space for residents’ daily life and work,and the basic unit of urban social governance.As a multi-ethnic community,it is an important front to promote ethnic unity and carry out ethnic work.However,no matter it is a basic unit of social governance or a front for carrying out urban ethnic work,the improvement and strengthening of its governance ability cannot be separated from the guarantee of legal norms.The social norm,as an important part of the rule of law norm,and the autonomy norm is its main expression form,is the basic norm of urban ethnic interwoven community governance,plays a fundamental role in the construction and governance process of urban ethnic interwoven community,and is the main norm basis for various subjects of urban ethnic interwoven community to conduct self-management and self-restraint.In order to further clarify the birth form,generation path,function and actual operation of urban ethnic interwoven community autonomy norms in community governance,promote the realization of community good governance goals.This paper takes the research on the autonomy norms of urban ethnic interwoven community governance as the topic,explores the problems existing in the construction and operation process of the community autonomy norms,and seeks ways to improve the problems.This paper is divided into five parts,including:The first chapter clarifies the related concepts and elaborates the theoretical basis of the research.First,it clarifies what is the interlocking community for urban ethnic groups,what is community governance and what is the norm of community autonomy.Ethnic intermingling is the concept of socialism with Chinese characteristics,and it is a new idea,a new method and a new theory of constructing unity,mutual assistance and harmonious ethnic relations.Ethnic interlocking community refers to a community of spirit,culture,interests and destiny formed by many ethnic groups in a certain region.Community autonomy norm refers to the sum of norms formulated or recognized by autonomous organizations,social organizations,enterprises and institutions in the community under the guidance of the Party and the government,based on their own and public institution construction and development needs,in the process of realizing self-restraint and self-regulation.As one of the forms of social norms,it is different from customary law and soft law.Secondly,it expounds the theoretical basis of this paper,namely the theory of ethnic intermingling,the theory of governance and the theory of socialist rule of law with Chinese characteristics,and points out that the theory of socialist rule of law with Chinese characteristics is the theory of multiple norms.Chapter two discusses the types of community autonomy norms.It is proposed that the construction of community autonomy norms is carried out around community grass-roots Party organizations,self-governing organizations,work service institutions,enterprises and public institutions and community residents.The types of norms include organizational construction norms,management service norms and norms involving residents’ communication behaviors,such as residents’ conventions,community conventions,etc.The third chapter focuses on the generation and creation of community autonomy norms.Firstly,the background and path of the generation of the autonomous norm are discussed.It is considered that the autonomous norm is the product of heavy game and the product of multi-subject cooperation.Secondly,the author discusses the creation subject and process of autonomy norm.It is pointed out that the subject of community autonomy regulation is pluralistic and different types of autonomy regulation have different creation procedures.Chapter four discusses the role of different types of autonomy norms in urban ethnic interlocking community governance and their interaction with other types of norms.First of all,different types of norms of community autonomy play different roles in community governance.The role of norms of organization construction lies in promoting and strengthening the construction of grassroots party organizations,and firmly forming the bastion role of grassroots Party organizations in community governance,so as to better lead community governance and construction.The management service standard is to restrict the behavior of the staff of the community organization,improve the work efficiency and optimize the community public service.The function of the norm of residents’ communication behavior lies in regulating the community communication behavior and guiding the community to form a good fashion.Secondly,the interaction between autonomous norms and other types of norms is mainly manifested as the functional complementarity and cooperation formed by the difference of functions.The fifth chapter discusses the existing problems in the construction of urban ethnic interwoven community autonomy standard and its improvement suggestions.It is believed that the main problems in the construction and operation of urban ethnic interwoven community autonomy norms are the lack of smooth connection between community autonomy norms and legal norms,the lack of binding force between different types of autonomy norms,the low participation of residents in the formulation process of community autonomy norms,and the lack of supervision and safeguard measures in the implementation process.Therefore,we should strengthen the guidance of law,improve the filing and review mechanism of community autonomy norms,and enhance the legitimacy,coordination and unity of community autonomy norms.Strengthen the promotion and publicity of community autonomy norms,appropriately set up punitive provisions in the norms of community autonomy,strengthen the binding force of community autonomy norms;Cultivate community residents’ sense of autonomy,improve the mechanism of residents’ participation in the formulation of autonomy norms,in order to gather community consensus and strengthen the public opinion foundation of community autonomy norms;We will improve the supervision and guarantee mechanism for the implementation and implementation of community autonomy norms,and promote the effective operation of community autonomy norms.
