| Marine microplastics are plastic debris with particle diameter less than 5 mm in the ocean.With the increasing pollution of marine microplastics,its impact on marine ecology and coastal economy is becoming more and more serious.Because of the vastness of the ocean and the difference in legal status of different ocean areas,marine microplastics management has been a difficult problem in global ecological governance compared to land-based environmental management.How to move from scientific research to substantial pollution control and global governance is now a common concern of the international community.The global nature of the marine microplastics problem also urgently needs to be adjusted by international law.Therefore,a more in-depth study of marine microplastics governance from the perspective of international law is not only of theoretical significance,but also of practical significance.This paper first explains the definition of marine microplastics,clarifies its sources,and its specific economic and environmental impacts.Secondly,the international legal documents involving the governance of marine microplastics are specifically discussed at three levels: global,regional and national.On the basis of clarifying the existing international legal framework,the dilemmas faced by the existing legal system are analyzed,such as the existence of fragmented rules,inconsistent standards,and unsatisfactory compliance.Then,in view of the shortcomings of the existing regulation,feasible suggestions for further improving the governance are put forward in terms of improving the rules of marine microplastics governance and establishing the enforcement mechanism of marine microplastics governance.Finally,the paper proposes strategies to improve the marine microplastics governance in China,taking into account the practice in China. |
