The Dilemma And The Way Out Of The Permanent Residency System For Foreigners In China

In the age of globalisation,there is more frequent cross-border movement of people,which has increased the level of talent and capital competition across the world.High-level foreign talent,either carrying technology or capital,has grown to be a significant force for the economic and social development of the importing countries,and the competition for talent and capital among countries has continued to become the core focus of the struggle for total national dominance.Attracting foreign talent and investors has become a crucial national strategy as China’s economy rises to become the second largest in the world and its overall national power increases significantly.More than 30 years since its implementation,the Permanent Residency System for Foreigners in China has inevitably revealed a number of problems that need to be solved and provide broad prospects for the Permanent Residency System for Foreigners in China.Aside from an introduction and a conclusion,the study is split into four major sections:The first section introduces the fundamental meaning of the Permanent Residency System for Foreigners in China.First,the right to permanent residency—which encompasses both the de facto status of having no period of residency and the rights and obligations of foreigners who have attained permanent residency status—is the fundamental component of the Permanent Residency System for Foreigners in China.The four facets of admission,management,rights and treatment,and social integration programmes should be considered when analysing the Permanent Residency System for Foreigners in China.Second,it is necessary to learn about the Permanent Residency System for Foreigners in China.First,the system can attract foreign talent and investment,achieving the domestic nation’s economic and social development goals.In the second part,a comparative study is conducted on the Permanent Residence System for Foreigners in extra-territorial countries.Through analysing the practices of three different types of countries,namely traditional,emerging and non-traditional immigrant countries,in developing their Permanent Residence Systems,the study focuses on four aspects,namely,the admission of foreigners,the content of management,the rights and treatment,and the social integration measures of foreign countries,in order to summarise the commonalities and characteristics of foreign countries and draw useful experiences for reference.The third section provides an objective assessment of the current state and problems with China’s permanent residency system for foreigners,including the issues with improper application type consideration and excessively strict and unclear application requirements.In terms of government management content,there are issues like non-transparent approval procedures,outdated assessment mechanisms and insufficient attention to the social integration of permanent resident foreigners.In terms of rights treatment,there are more restrictions on rights and treatment and a lack of channels for redress.These issues are brought on by the requirement to improve the content of the law,the external attitude of the dominant society,and the Misallocation of social resources.In the fourth part,based on the aforementioned discussion,an analysis of the improvement of the Permanent Residency System for Foreigners in China is conducted in the light of the actual situation in China.The improvement of the Permanent Residence System for Foreigners should be carried out in the following four aspects: Firstly,clarifying the Permanent Residence System for Foreigners in the legislation,quantifying the types and criteria of applications,clarifying the content of rights and treatment,and facilitating the channels for relief of rights.Secondly,the management of the Permanent Residence System should be improved by introducing a simplified and efficient approval and authorization procedure,drawing on the legal means of immigration in line with the development of the situation,and paying attention to the integration of permanent resident foreigners.Finally,it is also necessary to improve the supporting measures for the Permanent Residence System,i.e.to focus on applying digital technology tools,to encourage the development of industries related to permanent residence,to strengthen the appeal and influence of positive publicity.
