A Comparative Study On The Permanent Residence System Of Foreigners Between China And America

The permanent residence system for foreigners is the general term for the legal system governing permanent residence of foreigners formulated by the country of residence.It consists of a series of management systems such as the application,approval,acquisition,loss and welfare of foreigners' permanent residence qualifications and management systems.These systems include both substantive regulations and procedural requirements,and they are the sum total of the legal systems governing permanent residents of foreigners by sovereign states.With the rapid development of China's economy,more and more foreigners are attracted to reside in China,which has also prompted the country to put forward better requirements for the management of foreigners' permanent residence.People's Republic of China on the administration of permanent residence of foreigners(Draft Version)on February to solicit opinions from all sectors of society,indicating that China has begun to gradually improve the legal norms concerning the permanent residence of foreigners.This article starts with the basic meanings of nationality,foreigners,permanent residence,and introduces the permanent residence system of foreigners,and then finds that both countries have established laws and regulations,which are determined by the two countries.In terms of the competent departments,institutional settings,division of responsibilities,etc.It can be seen that both countries have adopted the development and implementation of the permanent residence system for foreigners as one of the important means to maintain national security,at the same time,both countries attach importance to setting different conditions,attract high-level talents and protect the basic rights of people.By analyzing the respective characteristics of the foreign permanent residence systems of the two countries,it is proposed to introduce a special and unified "Immigration Law" to build a comprehensive foreign permanent residence legal system to improve China's foreign permanent residence legal system;Establish an interdepartmental information management system to realize data sharing and improve the efficiency of permanent residence management;improve the acquisition of permanent residence qualifications for foreigners in China through the introduction of scientific evaluation methods,quantify assessment standards,and refine the categories of permanent residence qualification applications;implement permanent residence qualifications and treatment,promotion of the social integration of permanent residents and other suggestions for reference,we hope to develop the permanent residence system for foreigners that meets China's development needs based on China's national conditions,so that it can better play the role in attracting talents.
