Research On The Right To Formulate Internal Party Regulations In The Working Organs Of The Party Central Committee

After the Political Bureau of the CPC Central Committee revised the Regulations of the Communist Party of China on the Formulation of Intra-Party Regulations(hereinafter referred to as the "Regulations")in September 2019,the system of formulating internal Party regulations has been continuously improved,and the position of the working organs of the Party Central Committee in the entire formulating system has been continuously clarified.The working organs of the Party Central Committee have the power to formulate internal Party regulations from the Central Committee to the Central Committee,and the power to formulate internal Party regulations at the provincial level,and has a "pivotal" position in the entire system of formulating internal Party regulations.However,the power to formulate internal regulations of the working organs of the Party Central Committee has also exposed some problems in the practical operation,such as: the scope of the main body of internal regulations of the working organs of the Party Central Committee is not clear enough,the authority of the formulating body is difficult to define,and the supervision mechanism is difficult to be effectively played,and the existence of the above problems has a negative impact on the practical operation of the right to formulate internal regulations of the working organs of the Party Central Committee.Therefore,this paper clarifies the scope of the main body of formulating internal regulations of the working organs of the Party Central Committee,defines the authority of the working organs of the Party Central Committee to formulate internal regulations,improves the supervision mechanism of the power to formulate internal regulations of the working organs of the Party Central Committee,and improves the normative system of the internal regulations formulation power of the working organs of the Party Central Committee to ensure their good exercise.This paper is divided into four parts to study the power of the Party Central Committee to formulate internal Party regulations.The first part conducts research on the nature and status of the power to formulate internal party regulations in the working organs of the Party Central Committee,and introduces the nature and status of the power to formulate internal regulations in the working organs of the Party Central Committee.The second part includes the normative design of the main body of internal party regulations of the Party Central Committee’s working organs,and analyzes and gives solutions to the problems of unclear scope of the internal party regulations of the Party Central Committee’s working organs,unclear subjects in the Party Central Committee’s working organs that have the right to formulate internal Party regulations,and whether the Central Commission for Discipline Inspection is the main body of Party regulations formulation in the Party Central Committee working organs.The third part introduces the authority of the Party Central Committee working organs to formulate internal Party regulations,and proposes corresponding improvement measures in view of the unclear authority of the Party Central Committee working organs authorized to formulate Party regulations and the existence of "dual identities" in some Party Central Committee working organs,and on this basis,the authority to formulate Party regulations of the Party Central Committee working organs is defined.The fourth part discusses the pre-review and filing review system of the Party Central Committee’s working organs,and puts forward suggestions for revising the "failure" of the pre-review and the imperfection of the filing review system.
