| The trial team is to complete the specific trial work task,with the post judge as the core,and configure the judicial auxiliary personnel that can meet the relevant types of dispute cases,so as to construct a fixed trial structure composed of personnel as a more standardized litigation unit for trial operation.As a concept of team management in management science,the trial team has been exploring in the process of judicial reform,and there is no specific composition model.At present," let the judge,let the judge be responsible " as the goal vision of judicial reform,by separating the past administrative power from the judicial power,the focus of the court ’s work is more focused on the handling of cases.This system innovation has achieved good results in courts across the country,and has been greatly improved in the efficiency and quality of handling cases.However,many problems have also been exposed in the process of practice,which need further analysis and formulate relevant supporting countermeasures to improve the system.This paper makes a further study on the construction of trial team through systematic discussion.Firstly,it discusses the research background and significance of the trial team,and explains the related concepts and theoretical basis.The construction of the trial team should grasp the macro direction and pay attention to the details,which is conducive to the more efficient operation of the trial and the ultimate realization of social fairness and justice.This paper expounds the concepts of post judges,judge assistants and clerks as the composition of the trial team,and briefly analyzes the theory of judicial independence and the theory of human resource management in the public sector used in this paper to guide the further improvement of the construction of the trial team.Secondly,it analyzes the problems existing in the construction of the court trial team in Hebei Province and the causes of the problems.It analyzes the problems existing in the current court trial team from the perspectives of strong administrative color,vague role positioning of judge assistants,insufficient number of trial assistants,and imperfect case distribution mechanism and assessment mechanism.The reasons are analyzed from the aspects of the deviation of people ’s understanding caused by the inconsistency of theoretical understanding,the lack of system regulations,the ambiguity of functional positioning,the simplification of formation mode and the uncertainty of evaluation of difficult operation effect.Finally,some suggestions are put forward for the construction of the court trial team in Hebei Province.Through the flat management,the core position of the judges in the trial team is highlighted,the scope of responsibilities of the members in the trial team is clarified,the flexible division method is designed,and the performance appraisal mode of the trial team is improved.It is hoped that it can contribute to the construction of the court trial team. |
