Study On The Anti-monopoly Problem Of Professional Football In Our Country

Since professional football entered China at the beginning of last century,with the strong support of national sports departments,its scale has been expanding and the degree of professionalism has been significantly enhanced.Although the development of professional football reform in our country for more than 20 years,the achievements obtained are obvious to all,but professional football is facing a lot of difficulties,if the problems such as fake ball,black whistle,match violence,player’s unpaid salary and so on,monopolistic behavior has restricted the healthy development of professional football.Therefore,it is very important to find out the source of monopoly in professional football and take perfect anti-monopoly countermeasures.This article mainly takes our country professional football as the main research object,concrete analysis professional football anti-monopoly question.By the methods of literature,expert interview,Case Analysis and data statistics,this paper first sorts out the general situation of the Reform and development of professional football in our country and the existing problems,second,it points out the concrete manifestation of monopoly behavior of professional football in our country through cases,puts forward the harm brought by monopoly behavior,and then makes a comparative analysis through the practical cases of“Anti-monopoly Law” at home and abroad,draw the Enlightenment to our country,finally put forward our country professional football anti-monopoly countermeasure research.The results of the study are as follows:(1)recalling the three stages of the development of football professionalization in our country,we find that the process of football reform is a tortuous process of institutionalization,which does not fundamentally promote the overall development of football in our country,instead,it has created more problems and made football worse and worse,this includes the endless corruption,the“Group withdrawal” of sponsors,the serious loss of fans due to lack of credibility,the frequent transfer of clubs due to serious losses,sports performance far behind other developed countries,etc..(2)there are three reasons for the problems of professional football in China: first,professional football is not included in the scope of“Anti-monopoly Law”;Third,the excessive intervention of administrative forces,which is mainly reflected in the administrative management of the Chinese football association has a strong administrative color;(3)the three stages of the professional reform of professional football in our country are marketization only in form,but the system has not realized marketization,which leads to four kinds of representative monopoly behaviors of professional football in our country,including contractual monopolization,club abuse of market control,operators concentrated malicious manipulation of the game,Football Association administrative exclusion restrictions on competition,and so on,and through the classic case of professional football monopoly behavior analysis.(4)European professional football "Anti-monopoly Law" practice enlightens our professional football "Anti-monopoly law" should confirm the scope of immunity,grasp the appropriate scale of immunity;Clear professional sports monopoly behavior of the identification rules.(5)With the rapid development of professional football in our country,monopoly is one of the factors that restrict the development of professional football,it is proposed to make professional football within the jurisdiction of "Anti-monopoly Law",to formulate the system of exemption of monopoly behavior of professional football,and to strengthen the legal relationship between "Anti-monopoly Law" and various departments,some effective measures,such as improving the publicity and education of "Anti-monopoly Law",standardizing the regulation process of administrative monopoly behavior of CFA,reforming the transfer system of professional players,establishing multi-channel ticketing and breaking tie-in,etc.,in order to solve the problem of anti-monopoly professional football to provide effective governance.
