Research On The Role Dilemma And Countermeasures Of Social Workers In Family Trials

With the rapid development of social economy,the main contradictions in China’s society in the field of family justice are mainly manifested in the conflict between the awakening of individual rights consciousness and the altruism of marriage and family,as well as the conflict between economic rationality and family ethics.In 2016,the SPC issued two opinions on the reform of the family trial mechanism,putting forward guiding suggestions on the contents of family mediation,family investigation,psychological counseling and other systems,emphasizing the exploration of diversified family dispute resolution methods,actively introducing social forces to participate in family dispute resolution,and forming an organic combination of judicial,administrative and social forces.Therefore,social work represents a professional social force,which has independent professional value and working methods,and the intervention of social workers can play an important role in family trials.This paper uses the conceptual framework of role theory to study the role dilemma of social workers in family trial work based on the family trial practice carried out in the family juvenile trial division of Y Municipal People’s Court.With the help of the interview method and observation method,social workers communicate with the participants in the family trial,observe the emotions,cognition,words and deeds of different family subjects,and analyze the expectations of all parties to the role of social workers,so as to facilitate the provision of targeted family services.Practice has found that in the family trial cases carried out by social workers at different stages,such as family investigation,family mediation and social care,the cases mainly involve custody disputes and divorce disputes.Therefore,based on the privacy of family disputes,social workers should always uphold the professional ethics of confidentiality,self-determination and fairness,assist the court in completing family trial work,and help the service recipients resolve family disputes.It is found that the role dilemmas of social workers in different stages of family trial are respectively role ambiguity,role gap and role conflict.The specific manifestations are as follows: the parties in the family trial to the social worker’s identity and responsibility ambiguity;The gap between social worker role cognition and practical ability;The conflict of expectation on the role of social worker.Based on the trial practice and work status,countermeasures are put forward from three aspects: in terms of law and policy,the legal status,power and responsibility of social workers are clarified;In terms of working mechanism,the linkage mechanism of social workers in hospitals should be established.In terms of professional ability,we should strengthen professional skills training for social workers.Social work involves professional social forces in family adjudication,which is conducive to realizing substantial justice in family adjudication and actively exploring diversified settlement mechanisms for family disputes.
