Since the National Sports Commission formulated and issued the Opinions on Deepening the Reform of the Sports System in 1993,which required further reform of the sports administrative system and transformation of the functions of the sports administrative departments,promoting the reform of streamlining administration and delegating powers,innovating the sports administrative management methods,and clarifying the relationship and power lines between the substantive associations and the sports administrative departments and sports institutions have been the key contents of the reform of the sports system in China.However,during the decades of long reform process,the sports administrative system has not really clarified the relationship and authority boundaries between substantive associations,sports administrative departments,and sports institutions.Not only has it not effectively implemented the promotion of decentralization reform,but also through institutional loopholes such as "two brands,one team of people",sports power is firmly bound within the administrative department system.The power structure of the sports system has been out of balance for a long time,the physical boundaries have been blurred for a long time,and secondary problems continue to arise.Compared with the reform requirements proposed by the state for the sports system,there has always been a large gap.As a result,it is not possible to fully utilize the institutional advantages of China’s national institutional reform,nor can it fully drive social market forces to promote sports development.Nowadays,the deepening process of institutional reform,the increasingly fierce competition in international affairs,and the increasingly prosperous social market environment all require that the sports system must improve the level of sports development as soon as possible,strengthen its sports governance capabilities,and improve its sports governance structure as soon as possible.It also requires that the sports system must quickly get rid of the remaining problems and reconstruct the operational logic and mode of sports administrative power,Thoroughly implement the reform requirements of the sports administrative system.Therefore,it is urgent to expand the analytical perspective of sports administrative power,theoretically analyze the internal logical relationship of sports administrative power,and find the direction and driving force for further deepening the reform of sports governance.This study analyzes the elements of sports administrative power through literature review,expert interviews,case analysis,and logical analysis.From the perspective of social contract theory,it focuses on the current difficulties and future reform directions of sports administrative power.Research suggests that in the current practice of sports administration in China,there are still practical difficulties in the allocation,operation,ensurance,and regulation of administrative power,including the need for further optimization of administrative power allocation,further regulation of administrative power operation,further development of administrative power ensurance,and further supplementation of administrative power regulation.The direct reason is that the implementation of the new system still needs to be gradually improved,and the second reason is that in the process of implementing the reform of decentralization and decoupling,the decoupling is incomplete and the decentralization is not standardized,leading to insufficient construction and development of the power of social administrative entities,as well as the transfer of some administrative power to the vacuum zone of supervision and restriction.According to the social contract theory,public power essentially comes from the transfer of each combiner in the collective to the whole collective of his own and his own rights.The public power possessed by the community resulting from this combination cannot exceed the limits of the public agreement,and the administrative power is only the individual power entrusted by the community to the administrative officials to exercise in order to realize the collective public will.Applying this theory to the field of sports administrative power,it is found that it is precisely because of the confusion between the nature of the government and the government’s competent institutions and the nature of sports social organizations as independent collectives that the power of sports social organizations lacks the social contract basis of their own as social autonomous organizations.They cannot form independent will,independent life and independent real power,and can only be silent in the traditional government led mode,Obeying the individual will of officials,it is impossible to truly draw a clear line with government agencies and government regulatory institutions,making the reform of the sports administrative system a mere formality,resulting in overlapping and misplacement of powers among different sports administrative subjects,and even causing some sports administrative powers to lose or become difficult to supervise,leading to practical difficulties in the allocation,exercise,supervision,and restriction of sports administrative powers.Based on the theoretical guidance of social contract theory and the practical practice of sports administration,this study believes that deepening the reform of sports administrative power should take clarifying the nature differences of sports administrative power among different subjects,clarifying the functional scope and power content of different subjects,and strengthening the supervision of sports administrative power as the basic reform principles and directions.The reform path includes further regulating government functions and constructing a new sports nationwide system;Continue to promote decoupling reform and implement the autonomous operation system of sports associations;Improve the sports supervision system,and supervise and restrict the administrative power of various subjects in sports from multiple dimensions.
