Chinese Patent Surging: Regional Distinction, Driving Factors And Coordinated Developing Strategy

In the era of knowledge economy, intellectual property rights especially patent are highly valued. In the past decades, China`s economy and patent quantity are both being taking-off which have been labelled world widely as China`s speed or China`s miracle. China`s patent quantity has been growing quickly ever since 1985 when China`s patent system was established. Since 2001, the average growth rate of invention patent application of China has been fluctuating around 25% to 30%. China`s long last high growth is unique to the world. On one hand, China`s patent surge may indicate the rising of innovation capacity, but on the other hand, it also attracts questioning and criticism about patent foam or rubbish patent etc. What scholars and government most concerning about are, 1) what factors and by what kinds of mechanism, are driving china`s patent explosion? 2) do related driving factors especially patent promotion polices reduce the quality of patents? 3) what developing strategy route should the nation and regions choose respectively, and further, what polices of them should be improved, to fulfilling the target of building an intellectual-property-rights-power country?Under the background above, the paper, from the perspective of regions(provinces), studies on the influencing factors and developing strategies of patent quantity and quality, based on large numbers of samples and research methods as patent-ometrics and theoretical deduction, qualitative analysis and econometrics etc.(1)Characteristics of regional patent surge with multiple perspective. A region(sub-region)-field(technical filed)-Patentee model, namely RFP model, is established based on patent-ometrics. Literature classification, the gini coefficient, matrix map and multidimensional scaling analysis are comprehensively applied as methodology to analyze, describe and visualize regional distinctions.(2)Theory model, impact mechanism and identification of key influencing factors of regional patent surge. Starting from the relationship between technical innovation and patent quantity, a theory model, named ECP model, is proposed, which meets the need of comprehensively, systematically and mechanism-internally analyzing regional patent rising. With the ECP model, impact mechanism(impacting route) is further analyzed with system dynamics method. Any factor would impact patent growth via at least one of three dimensions of ECP model. 23 key influencing factors, patent subsidy policy, patent awareness and new-and-high-technical-enterprise-certificaiton policy(NHC policy) has been identified via qualitative analysis method and based on case study.(3)Impact of NHC policy on the patent rising of different regions, industries, ownerships. 6 hypothesis are risen to explain the impact of NHC policy on patent quantity and dummy variant of NHC policy is introduced in the patent production function on which variable coefficients and constant coefficient of panel data model are combined to conduct regression. It is found that, NHC policy has significantly promoted the patent application of enterprises. The policy effect is more significant on non-invention patent. There are significant different effects of NHC policy on patent rising in perspective of regions, industries, scales and ownerships.(4)Impact of subsidy policy with different phase and level, on patent rising of different types of innovators in a dynamical perspective. A text dataset of regional patent subsidy policy is collected, based on which characteristics of regional patent subsidy is outlined systematically. Dummy variants are designed to represent to main contents of subsidy policy, i.e., the phase and level, together with which the effects of regional subsidy policy on different kinds of innovators are disclosed in regressions on negative binomial distribution model. The paper, for the first time as we know, analyzes the influencing factors of regional PCT patent rising as well as domestic patents.(5)Assessment of the regional patent application quality and its influencing factors based on patent legal statues information. After a definition comparison between patent quality and patent application quality, the paper proposes a method to evaluate regional patent application quality via patent grant rate and examination application rate. Empirical assessment on regional patent application quality is conducted based on text mining of around 1 million patents. Logistic regression model is applied to analyze the impacts of patent promotion policy and other factors on patent application quality in perspective of the whole nation, enterprises, university, research institutes and privates.(6)Strategy and policy suggestions to the coordinated development of regional patent quantity and quality. On the inconformity of regional patent quantity, quality and innovation capacity, the paper proposes that the developing idea as coordinated development of regional patent quantity and quality. Five kinds of strategies are designed, namely, quantity dominance, quantity priority, quality dominance, quality priority and quantity-quality-even for region patent developing. Suggestions are also proposed for NHC policy, subsidy policy and other related policies.The thesis systematically reveals the inequality in source of regional patent application surge and the inconsistency between quantity and quality of regional patent development. 23 key driving factors, patent subsidy as a typical example, are identified and impact mechanisms of related factors to patent surge are analyzed as well. Effect of subsidy policy, NHC policy and other related factors to regional domestic patent quantity and quality and to regional PCT patent quantity are revealed via econometric models in multiple perspectives. Finally the thesis proposes some quantity-qualitycoordinated developing strategies based on regional distinctions and improving suggestions for related policies. The conclusion in the thesis have some theory and factual inspiration to the construction of intellectual property right power country.
