In the context of globalization, China's policies, supported by her new economic power, will most likely create an increasing impact on international politics, economy and culture. As China proceeds to integrate into the WTO through the enactments and implementations of new policies, the Chinese will have the opportunity to use existing highly effective international intellectual property protection laws to promote the development of their cultural industry, while maintaining and protecting the integrity of their heritage and culture. Thus, the increasing impact and influence of Chinese culture in the international cultural industry form an important subject of research.In this paper, the author endeavours to study the advantageous position of China's millennial civilization by avoiding the use of antagonistic terms such as "strategy", "competition", and "strength", while favouring the fundamental category of "nourishing drizzle" (润物细无声)-meaning an impalpable but effective influence-to argue that Chinese culture's real power derives from its creativity, tolerance, and appeal, rather than from its traditional economic or military resources. Moreover, both China's excellent cultural values and her thousand year old civilization prove that Chinese culture has a strong vitality. China's cultural connotations and values are the source of this vitality. This source of vitality is also the main source of China's digital content industry.Although the subject of this study focuses on the effects of cultural policies upon the "re-creation of national elements", its main purpose is to discuss:the development, direction, basis, strategy and practice of national cultural policies; the effect of the digital information age on the protection and propagation of China's rich culture; the Chinese digital information industry development's impact on Chinese cultural and economic values; the influence on the increase of national creativity, and the result of domestic policy execution; the establishment of copyright laws to support present claim of originality of Chinese national elements, and acquire an international leadership in the political, economical and cultural areas.This thesis'main argument is based on information and data from the digital content industry. It introduces the concept of "re-creation of national elements". This proposal is based on the view of intellectual property rights protection as a core system of globalization and the principle of culture diversity protection. Secondly, this thesis analyzes the factors affecting the "re-creation of national elements". These include:the development of information technology; modern lifestyles; the trade of international culture; and the safety of national culture. Lastly, by using the digital content industry's development as a case study, this thesis analyzes the principles of cultural policymaking, its implementation and results, both domestically and abroad. Furthermore, it offers a perspective about the impact of policy making upon the path of "re-creation of national elements". It clearly points out the need for China's policy makers of an overall, systematic and in-depth understanding when defining targets of social development and the leading values of culture and economics.Based on these discussions, this thesis recommends the adoption of the concept of "re-creation of national elements" when defining cultural policies. It also attempts to design guidelines for the implementation of "re-creation of national elements", and explores methods of policy formulating strategy, principles and implementations that might strengthen cultural creativity.
