The Theory of Rights Justice is an old topic.In the Western discourse system,people's exploration of the Theory of Rights Justice never stops,from the worship of "rights theology" to the extreme admiration of "innate human rights" and natural rights.The Theory of rights justice has gradually become a cornerstone of Western liberal theory.The cornerstone of the building is regarded as the eternal truth that the bourgeoisie uses to maintain its rule.However,no matter whether it is the"rights theology","innate human rights" or the theory of natural rights,in the Marxist materialistic view of history,it is a non-historical existence and does not have the meaning of universal truth.In Marx's view of history,the issue of rights is a historical issue,and the issue of justice is also a historical issue.In Marx's view,rights justice as a compound concept,although there are abstract aspects,it cannot just resort to abstract understanding.Rights justice is not general justice,but a kind of rooted existence and special existence with rich meaning.It is a normative category that combines facts and values.What this normative category expresses is a proper and reasonable value orientation.It is not only a requirement of society for individuals,but also a requirement of individuals for society.Man is separated from the natural world and exists as a man,and he actually has a certain right to exist as a man.Human rights are manifested in the relationship between man and the nature,in the relationship between man and society,man and history,and in the relationship between man and himself.The so-called cognition rights,labor rights,social rights,economic rights,political rights,moral rights,religious rights,and disputes since the modern commodity economy between individual rights,social rights,and state power are often discussed,all of which are actually just different manifestations of human rights in different fields of activity.The specific manifestations of human rights are in various forms,so different specific rights will have different characteristics.In the realm of nature,human rights are subject to the constraints of human activity capacity,while in the field of social history,the development of human rights is also affected by social historical factors such as class interests,laws,customs,and habits;In the natural realm,human rights are prominently manifested in the breaking and control of external natural forces.In the social and historical realm,human rights are more prominently manifested in the transcendence of past activities and the expansion of their own power.Therefore,when we examine human rights in the social and historical field,the issue that needs attention and clarification is the relationship between human rights and social norms.From the perspective of Marx's view of history,human beings as a social being,as the "sum of social relations" as Marx said,the rights and justice issues that people must face and encounter in the human world can be summed up,mainly including four types.Type:One is the justice in the generation of rights,the other is the justice in the distribution of rights,the third is the justice in the enjoyment of rights,and the fourth is the justice in the protection of rights.When the issue of rights justice is regarded as a specific historical issue,it is not an hierarchical rights justice,and in the commodity economy stage,it is formal rights justice.Only in the communist society can real and substantive rights justice be achieved.Therefore,the essential attributes of rights justice are actually manifested in three aspects:historicality,class,and practicalities.Hence,the rights justice is achieved by human struggle,and the human struggle has a historical symbiosis with rights justice.Since the category of right justice is a reflection of the value of social norms,it has both a normative function and an evaluation function.Therefore,as a social norm,there is a question of whether it is reasonable or not.On the question of whether history is reasonable or not,populist,moralistic,and idealistic historical views cannot be used as a yardstick to evaluate whether history is reasonable or not.From the perspective of Marx's view of history,the important scale and coordinates to evaluate one kind of justice is reasonable and progressive or not is necessity in the process of social and historical development.In contemporary China,the Marx's theory of Right Justice has great theoretical and practical significance.The theoretical significance is specifically manifested in:First,it provides ideological weapon to resist the erosion by Western liberalism;second,it contributes to adapting Marxism to the Chinese context,and it is conducive to the soundness and development of the Marxist disciplinary system.The practical significance is specifically manifested as follows:First,it is conducive to upholding the party's leadership over all work;the second is conducive to our people-centered philosophy of development;the third is conducive to adhering to the law-based governance;the fourth is conducive to maintaining a good social order and continuously promoting social progress;and the fifth is to contribute to building a harmonious and orderly socialist culture.
