The Legal Study On Transnational Operation Of Chinese Enterprises

It's well known that the inflow and outflow of capital are two necessary factors of the open policy in capital area. China has gradually become one of the major countries, which accepted most of the international investment since the establishment of the reform and open policy. But the investment from China has being less in quantity and efficiency contrasted with that to China. At the same time, there is not only gap in size but disadvantage in the way of investment and operation contrasted with western transnational corporations. Our transnational enterprises haven't learned how to operate according to global strategy. Now, the importance and essentiality of our investing outward has been not only testified repeatedly by domestic scholars, but adopted by the government. We can foresee that it will be the golden time for our outward investment after China's entry into WTO. So the article makes an indepth study on the legal questions of transnational operation of Chinese enterprises in order to give some advice to and support our transnational operation. The article discourse the subject from micro aspect, including the following contents: the body of transnational operation, the capital recomposition of transnational enterprises, the way of transnational operation, legal questions on capital movement of transnational enterprises, legal questions on the avoidance of adventure and the settlement of the disputes in transnational operation. The article comes to the conclusion that our transnational enterprises should be reformed according to the modem corporation system, should select the proper investing method according to their own characters, should make full use of the current measures in transnational operation fundamentally, should avoid the adventure scientifically and settle the disputes efficiently.
