Research On The Right Releaf Of Villager's Election Right In Villagers Committee Election

First , this paper analyses the basic theory of the Right Relief and expound its concept and three main ways and its main content. The writer thinks that the old saying "there is right, there is relief" is still practical and the law shall not only declare the right but also dispose the appropriate relief system.Second, this thesis approaches the legal characters of the villagers' elective right relief in country committee. The villagers' elective right is their democratic right which they elect the members of their autonomous organization and their basic right that the Constitution said. Therefore, the measure to solve the problems in the election of Village Committee should be in political and legal pattern.Third, this paper puts emphasis on analyzing the present situation , the type and the reason of the infringement of the villagers' election right in our country. There are two types of infringement of the villagers' electionright----Administrative main body' s infringement and others main body'infringement. The writer analyses their quality -. legal characters and their expressions. The main reason of the infringement is because of the imperfect law and their bad propaganda and organization.Finally, though the observation of the present situation and problems in the villagers' election right relief system does not benefit for protecting the villagers election right and guaranteeing the villagers' autonomy, but run against the basic spirit and the democratic demand in modern rule of law and the strategy of administering the country according to the law and the spirit of the 16th Nation People' s Congress Committee and so they should be improved. In order to set up perfect right relief system, we should take the measure of lawsuit, and strengthen administrative relief in mediate issues in the villager' s committee, set up the administrative relief system, improve the visit relief about the villagers' committee election. And also we should enhance the relief tovillagers' right of the country' s power administrate, and establish the NPC' s supervised relief system. Besides, we must reinforce the administrative direction to the election of village committee and the administrative punish .
