Research On Elementary Government Behaviors In The Process Of Villagers' Committee Election

The election of villagers' committee is the process to express political will and carry out democratic rights adequately for villagers, hi the process, the government, which drives the democratic course, plays the role of legislator, executive and supervisor. Specifically, as the basic organ of the government, township government connects peasants directly, its participation of the villagers' committee election performed not only in some active aspects such as directing, supporting and regulating, but also in some non-standard aspects such as resisting, non-acting and steering. The purpose of this paper is analyzing the behaviors and the reasons of the township government in the election of villagers' committee so that we can find some effective ways to correct the behaviors of the township government and reset its role in the villagers' committee election.The text of the paper is divided into three parts.The first part retrospects the evolvement of the elementary government in the country and the development of the villagers' committee election longitudinally. As soon as the establishment of the People's Republic of China, the Chinese government and the peasants continual reformed the form of the elementary government in the country, from Peasants Union to Town-Village system, and then from People's Community system to township government guided villagers' self-government. At the same time, as the civilian self-governed organization, villagers' committee was developed from the very beginning, and the way of villagers' committee producing consummated from government appointment to villagers' election.Using a lot of practical cases, the second part classifies the elementary government behaviors in the election of villagers' committee into four kinds from transverse aspect, they are support the election; resist the election; passive in the election and control the election. After that is the brief sum up and analysis of the four behaviors.Based on the historical retrospection and the practical description in the first two parts, the third part analyzes and explores the non-standard behaviors of the township government from the aspects of law standard, administration system and rural practice. And the author also tryingto correct the behaviors and reset the role of the elementary government in the election of villagers' committee. The government should play the role of a legislator and supervisor instead of an executive. The legislative power, executive power and the supervise power should be rearranged. The government should define the responsibility and the right in the election, and separate or share them with the directions above. In this way, the government can find its best role in the villagers' committee election, deal with the relationship with villagers' committee and villagers properly, and guide the healthy development of the election of villagers' committee.
