The Village Committee Election Administrative Tort Empirical Research

It takes about 25 years to form the system of the election of villagers' committee. According to the Constitute Law of Republic of China and the Organization Law of Village Committees, the Villagers' election right is one of the villagers' self-government rights and should be protected. Actually, in the course of the election of the villagers' committee, villagers' election right is usually invaded by the unlawful administration conducts from the government and its workers. The author focuses on the special causes of the phenomena and finds that the current laws about the villagers committee election in China are far away perfect. The absence of the system of right rescue lead to that the unlawful administration conducts can not be controlled effectively. So the laws should be progressed quickly and the system of right rescue should be established, including constitutional relief, administrative relief etc, to guarantee the villagers' election right.
