Consideration Of Relation Of Government And State-owned Enterprises From Administrative Law Viewpoint

The reformation of enterprise has a history over 100 years in the developed capitalist countries and their developments is in the maturity stage while the state-owned enterprises reformation in China are just at the very beginning step and there are considerable problems to be solved. It has a very important realistic meaning for China to carry on the enterprise reformation on a large scale under the condition to realize the transformation of economic system and economic increasing mode. At the same time the government has not solved the serious relationship problem of the departure between the government and the enterprise. It has a very important theoretical and practical meaning for the state-owned enterprises how to realize the departure between the government and the capital, between the government and the enterprise. The history, current situation and problem are inquired from administrative law in this paper. And combined with the related country practice, the departure between the government and the enterprise is inquired.
