Being the problem of the externality of tour itinerary product, it can neither motivate travel agencies to make further exploitation on tour itinerary product nor make a sound use of the existed tourism resource. As a result, it has caused series of problems such as the absence of deep innovation in travel market, the simplification of tour itinerary product, the unbalance of demand and supply, the hard establishment of vertical and divided work system, the competition of vicious price, the decline of service quality and so on.Based on this, it is necessary for travel agencies to make some measures by solving the problem of the externality of tour itinerary product, stimulating the passion on the development of the tour itinerary product, protecting the creative work, etc. If we can design a suit of system to ensure the use right and the profit right of tour itinerary product exploited by the travel agency with the awareness of creativity, and prevent other travel agencies from burgling them easily, a lot of new tour itinerary products with high additional value and meeting tourists' needs will come into being .As a result, we can obtain the achievement of the maximized avail to tourists, tourism resources and travel agencies.One hand, this article analyses the traits of tour itinerary product caused by the externality and does research on the primary idea, the basic type and the main reason according to the fact of the externality of tour itinerary product. On the other hand, by comparing the theoretical theory with the practical theory used to solve theexternality problem, a scheme to set up the use right market of tour itinerary is thought of. From the point of economics and law, this article tries to demonstrate the importance, the reason and the concrete measures of the scheme with the way of the standard analysis and the positive one.
