A Study On Rights' Assurance Of Deputy To The People's Congress

With the continuous development of society, representative system is widespread.China also chose it. People's congress system is China's fundamental political system. It can ensure the state power and reflect the will of the people. As the important part of it, the deputy to the National People's Congress takes the heavy responsibility of reflecting the people's benefit and request.So, when the deputy works, taking some measures to ensure the rights of the deputy is the need of the society and the law.With the development of the People's Congress system, the rights' assurance of the deputy in China is gradually established. According to the provisions of relevant laws, the deputy has some rights, such as the rights in the People's Congress, the rights out of the People's Congress and the assurance of special rights. Assuring the rights of the deputy has lots of advantages. It will improve the effectiveness of the deputy and perfect the People's Congress system. It will also keep the enthusiasm of the deputy and ensure the authority of the government offices.However, the rights' assurance of the deputy plays a important role in practice, there are so many drawbacks in the People's Congress. It needs more time and ways to improve and perfect the system of protection of the rights of deputy.In addition to the foreword and concluding remarks, the whole thesis is divided into four parts.First of all, set forth the theory of the rights' assurance of the deputy to the People's Congress.Through describing the rights and effect of the deputy to the People's Congress, put forward the meaning of perfecting the rights of the deputy and make the further analysis. Then by comparing with the guarantee to the western countries' representatives, put forward the problems about the rights of the deputy in China, such as,the deputy's rights in law, the deputy's rights in countries and the problems about guarantees for representatives to carrying out the duty.At last, provide some advice to solve the problems and perfect the system,such as, establishing the right guarantee system for China, enriching the relevant laws and establishing special insurance system for the deputy.In my opinion, improving the deputy's rights for the People's Congress is the important aspect of our National People's Congress construction, which is extremely complex. However, as long as all aspects of our long-term efforts, we will be able to gradually improve the rights of deputy to the People's Congress.
