Research On The Establishment Of Our Social Security's Independent Supervision Organization

Supervision of social security can not only ensure the safety of social security funds, and promote the implementation of social security policy, it is also beneficial to health and sustainable development of the social security system, but China's current regulatory status of Social Security is not so optimistic, the regulatory bodies of social security system are invalid, it needs further restructuring.In this paper, first, I make a simple introduction to several theories of social security supervision, on the basis of that I analyze and evaluate the problems of the social security's regulatory bodies from the existing regulatory institutions. In reference to the lessons of foreign regulatory agencies on the establishment of social security and on the basis of the actual needs of our social security's development, I think it is necessary to establish an independent supervision organization. I make some advices on regulatory elements, regulatory responsibilities, members of composition, institutional settings, operating principles, mechanisms, etc.By the inspection on China's social security's current status and the supervision of foreign social security's experience, I find in the social security regulation, the establishment of an independent regulatory organization have specialized help to improve regulatory decision-making executive scientific, democratic and transparent, to break the limitations of internal supervision, to form a monitoring mechanism of mutual supervision and mutual checks, to enhance the regulatory efficiency and effectiveness.To break the limitations of this internal control"right hand left hand control", the paper advocates that an independent regulatory agencies on social security must be established. The new established regulatory agencies have an overall supervision to the social security system, social security policy and social security funds. Under the guidance of independence and accountability to establish institution, insisting the principle of law and representation. Establishing Social Security Regulatory Commission in Central Government. It leads national social security regulatory authorities.Social Security Regulatory Commission exercises the right of supervision and management through the legislative authority. It is independent with the Government and the other social security administrations. It haves independent legal status, independent personnel arrangements and independent allocation of responsibilities. Social Security Supervision Commission has right to supervise the Ministry of Finance, Audit Department, Ministry of Civil Affairs, Ministry of Health, the Ministry of housing construction and other sectors ,which monitor the social security funds and the implementation of social security policies. At the same time, set up branches in each overall level, implement vertical leadership. Other social security institutions under its guidance and supervision.The members of Social Security Regulatory Commission are composed of the social security sector, financial sector, employers, employees, experts, representatives of Fund industry. In order to achieve regulatory goals and the higher efficiency of supervision, a sound operational mechanism must be established by Social Security Regulatory Commission. Through a series of institutional arrangements to achieve effective management, including legal protection mechanisms, responsibilities distribution mechanism, mechanism for public participation, accountability and disclaimer mechanism, assessment and error correction mechanism,system maintenance mechanism. That can establish sound internal environment and external environment to regulate the operation of its own, achieving the purpose of effective supervision in the end.
