The Analysis About The Environmental Legal Regulation In Cycling Economy

With the human's history stepping into a new century, environment and development have become the important issues the international society concerned about. How to coordinate their relationship has become a tough problem the human society faced with. At the turning point of the century, walking to knowledge economy and cycling economy are the two tendencies in coordinating the relationship between environment and development. Especially since the initiation of sustainable development strategies in 1990's, developing cycling economy and setting up cycling society have been regarded as an essential way to carry out sustainable development strategies.The idea of cycling economy sprouted in 1960's, and in 1990's, it was introduced to our country. It is safely to say that at present our country is only in a phase of introducing the concept and carrying out elementary study on it.This thesis started with an introduction to the related knowledge about cycling economy and dealt with several issues: the boundary line of the definition of cycling economy, the relationship between cycling economy and sustainable development, the dimension of cycling economy, the principle of cycling economy and its necessities. Then with the relationship between cycling economy and nomocracy as a transition, with the guide of the theory of Marxist political economy, namely economic base determines superstructure, the author made out that the development of cycling economy must be facilitated by the adaptive superstructure. This point introduced the key content in the third part of this thesis .In this part, the author employed the important components in legislation, administration, and law-abidingness. to impenetrate the whole part .As for the part of legislation on cycling economy, the author explained four issues: the ecological tendency of legislation, the construction of cycling economy law system, and the interpretation of The law of non-polluted production. As for the part of administrative law enforcement, the author explained the coordinating way of administrative agency and its specific administrative strategies and system. As for the part of citizen's law abidingness, the author elaborated on the problems of transforming the public's notions, accepting Green Education, improving the public's participating consciousness and building up Green Community. For a long time, the native academic field has been staying on the introduction of cycling economy from the angles of economy and technology. The study on the nomocracy construction is very rare. This thesis carried out a thorough analysis on this point and thus it has certain theoretic value and economic value.
