Research On The Legal Supervision Of Consolidation Model Of Our State-owned Commercial Bank

From the 1970s, an international economic integration has been becoming more and more popular, an international financial market has shaped. With development of the international financial market, the permeation and amalgamation in financial fields is strengthened and separation has hindered the promotion of financial products and services. International finance especially the financial field in developed countries all carry out the consolidation model. After entering into the WTO, our state-owned commercial banks still implement separation, which will be at a disadvantage. In order to promote the competitive strength and efficiency, our commercial banks should change into the consolidation model and learn from the advanced legal supervision of developed countries.This paper makes a deep research on the separation and consolidation of financial industry and legal supervision ,based on the new theory of division of labor force of new classical economic and modern financial theories. By constructing theory models and making positive analysis and case studies, this paper does research on the objective laws governing the evolution and provides some scientific basis and policy suggestions for the legal supervision of China.This paper constructs a new theory framework of the evolution in the financial industry, analyses the problem of separation and consolidation in the history of legal supervision, reveals the microeconomic mechanism of commercial banking, and affords a keen insight into legal supervision development. Based on the theory framework, this paper studies the evolution in the legal supervision of American financial industry, makes a comparative study of German, the UK, and a institutional analysis of the structure of financial regulation.It's focal point is to study the evolution in the division of legal supervision of Chinese financial industry. On the basis of recollecting the history and engaging in introspection, this paper dissects the problem of the evolution of financial system of China, discusses the inevitability and binding condition of consolidation of commercial banking. And finally, it provides the transitional strategy "to carry on three lines and progress step by step" in order to realize moderate degree of consolidation model, and expounds some important factors of the transitional strategy.
