| Desertification is one of the major environmental issues in the world today. Millennium Ecosystem Assessment in Desertification Synthesis on June 17th, 2005 showed that 10%~ 20% dryland was degraded in the world and about 1%~6% population of dryland lived in desertification district, but also 6 ~ 12 million square kilometres was threatened by desertification.United Nations Convention to Combat Desertification in Those Countries Experiencing Serious Drought and/or Desertification, Particularly in Africa, that is United Nations Convention to Combat Desertification(UNCCD), which is the first international convention on combating desertification and which is full of sustainability of social development. In fact, desertification is about land degradation: the loss of the land's biological productivity, caused by human-induced factors and climate change. China is one of the countries with serious threat of desertification in the world. Our country is devoted to implementing of UNCCD. In the past did keep his eyes on the forming of desertification, the monitoring of desertification, the evaluation of desertification and so on.With the rapid development of economy and society, the paper emphasizes the institutional obstacles on combating desertification in China. A study of combating desertification is based on the researches of the conception of desertification and the feasibility and necessity of desertification legislation in this text, which contains several parts, as follows: the basic principles, the basic theories, the legal systems and the liability of combating desertification legislation.From the anthor's point of view, the theory of sustainable development and the property rights of natural resourses and the law of limiting factor are playing an important role in studying on combating desertification legislation. This dissertation applies the analysis methods of comparison, positivism and theory. |
